Performance Bond Reminders: None. OLD BUSINESS: Kohl's / Sprin2 Prairie Phase 3 — Hwy 93 N; overall site layout and new retail store — We received more in on the final plat. We are still waiting for the Subdivision Improvement Agreement and Letter of Credit and Title Report with original signatures on it. They have a letter that addresses the bike path and topography issue. We are also waiting for the lighting plan. They wanted 40' poles originally, they have agreed to 30' light poles, but it has not been put into the agreement yet. Building elevations that reflect the architectural review. Lighting and building elevation issues would affect their building permit. They would like to put in the Kohl's pad in June, and have either an October, 2008 or March, 2009 opening date scheduled. Grease Monkey — 2322 Hwy 93 N; new auto oil/lube facility — make sure they get the connection to the adjoining parking lot. Goldberg is asking them to do the same thing. Costco has a right to a 200 ft view corridor between Grease Monkey and a Medical Clinic going in next door. The clinic wants the corridor centered on the property line, more or less. No one is happy with the architecture of the building. This will be left on the agenda. Silverbrook — 115 W Monture; new community center at the corner of Silverbrook Drive and West Monture Ridge. Community center building and sales office. Need to limit trees by the intersection due to traffic visibility. Ten foot jog in the property line, which is not shown in their site plan, which may be a setback issue. They wanted to eliminate a drain along West Monture Ridge, and Charlie told them no. This will be left on the agenda so Fire and Parks get a chance to look at this. NEW BUSINESS: None. PLANNING OFFICE ITEMS: Siderius Commons — Purpose of today's meeting is to get an overview from Jerry Nix, not necessarily to raise issues or formulate solutions. Highway 93 S, by-pass to NE, residential, park and open space. Self sustaining community. The Letter of Intent was rejected. 70 acre commercial portion. Anything that the residents would need. Three block town center. Base floor would have arts and crafts, bakery, McDonald's or Taco Bell, studios, etc. and housing on the second and third floors, however an art gallery could take up all three floors. The hospital wants to do a Summit South with a doctor's call center and imaging center. 4.6 acre and 10 acre park sites near Somers School District. K-8 to include a junior high school and an elementary school. They are working together to get them more land. They are trying to mitigate the impact on Ashley Creek. This project is between two major bike paths: Rails to Trails and Somers Rails to Trails. The by-pass will have a bike path all along it. There will be a bike staging area with a picnic area and bathroom facilities. There will also be townhouses along the main entryways. There will be more entry level, affordable houses. No high end houses. There will be row homes and townhomes with brick, stone fascias, or hearty plank. The homeowners' association will maintain the outside of the units. The cost for the affordable housing is $175,000, but the purchaser gets into it for about $135,000 with affordable house assistance with the Land Trust. There will also be affordable rental apartments. They will apply for tax credits which should be attainable with this project. At the end of 15 years, the Land Trust will be paid off and the developer will no longer be obligated to offer the housing as affordable. There will be a green belt, 200' from Ashley Creek setback. Wells are to provide irrigation for the property. Tested out as 700. Uses the same aquifer as the City uses. It could be used for domestic water use if needed. Total amount of open space is 4.88 acres and they have provided the north portion all open, and area next to school will be more of a developed park 39.6 acres of open space. Some of the possible services will be a hardware store, auto parts, grocery store, open space plaza, or medical care. Fronting portion 55' wide buffer and higher landscaped which provides screening. Soils test showed one area that has 9' water below the surface but is on main entrance way. 18' to 36' water table in other areas. Did test for FEMA and Army Corp. of Engineers and there is no flood plain. Ashley Creek is in a big flood plain risk. The by-pass will go right through the project. There is a 80' wide right-of-way along Ashley Meadows Road. Peccia did a Traffic Impact Study that warrants a light at that intersection at Highway 93 and the by-pass. Rights -in and deceleration lane for entry into the project. One or two left turns in along Cemetery Road. Right -in, right -out on old county museum property. Main exit out Ashley Meadows Road. Realignment of Cemetery Road. City airport is next to this project. The road design for Cemetery Road to Airport Road will remain a two lane. Water and sewer runs down the side to Old School Station. Capacity is there. Airport Flight Study was done by Peccia and it shows how it goes off the runway and what the building heights can be. Only significant impacts are in the northwest corner. This project is in the Runway Protection Zone (RPZ). The Fire Dept. wants to place a new station on this property, which may go in on the northwest corner. They have been working with the neighbors around this project. This will work well with the industrial area across Highway 93. Maps for the growth plan amendment. Area east will be B-2 Commercial, and Urban Residential will be RA-1 on the other side. Jeff asked what size of airplanes will be flying there as to the noise levels. They are in the path of the airport air way. Will setup to have drainage go through the middle. The well will be going through the permitting process. The tap aquifer is a closed system. This is not tied to any surface rights. Growth policy Amendment and annexation. Connectivity to land to the west. School site needs a letter from the school stating that they really want it. The parkland is fragmented. The County land is zoned industrial. Questions about the tunnel. Putting some policies on this project dealing with the growth policy first. He needs to talk with the DNRC about the well. Irrigation versus domestic use is also an issue. Valley Ranch — north of Glacier Town Center, R-2 zone. Draft plan. Residential townhouses, assisted living, apartments, tied to Wolford and Glacier Town Center. They have talked with MDOT about moving their right -in, right -out on Highway 93. The long park strip is for a buffer between this project and North Ponderosa Subdivision residents. The parkland next to the Ponderosa Subdivision has some drainage problems in the winter. Legends Court — Narda Wilson's project - Paul asked, "If we have a 10' easement in the right-of-way, why don't we extend the right-of-way?" Lot size is one reason. Sidewalk and curb will go in with the existing trees being preserved. The road dead ends. This will have a subdivision variance. The lot size would not fit the zoning requirements if we were to take more right-of-way. Generally, we need a sidewalk and public utility easement in the right-of- way. Fourth is a dead-end. Nicole will spell it out in her report the exact reasons for the exceptions in this subdivision variance. Paul is agreeing to this under duress, as he does not want to set a precedent. Discussion regarding notice to neighbors, which is unlikely due to state statutes regarding minor subdivisions. Three Mile Views — Has anyone received a revised Subdivision Improvement Agreement? Improved by $15,000 for the bike path. Mark from Public Works is working on this. 610 Meridian Road — annexation request on South Meridian Road across from 6th Street West, east of Wild Geese Gardens.
