P.M., TUESDAY, FEBRUARY 20, 20079 IN THE COUNCIL CHAMBERS AT CITY HALL
IN KALISPELL, MONTANA., MAYOR PAMELA B. KENNEDY PRESIDED. COUNCIL
MEMBERS JIM ATK.INSON, KARI GABRIEL, BOB HAFFERMAN, RANDY KENYON,
TIM KLUESNER, AND DUANE LARSON WERE PRESENT. COUNCIL MEMBER HAND.
OLSON WAS ABSENT.
Also present: City Manager James Patrick, City Attorney Charles Harball, City Clerk Theresa White,
Police Chief Roger Nasset, Finance Director Amy Robertson, Public Works Director Jim Hansz,
Associate Civil Engineer Susie Turner, Fire Chief Randy B rodehl, Community Development
Director David Foster, Housing Manager Lynn Moon, Parks Director Mike Barer, Planning Director
Tom Jentz, Senior Planner Sean Conrad, Planner Il Nicole Johnson, and Recording Secretary Judi
Funk.
Mayor Kennedy called the meeting to order and led the Pledge of Allegiance.
A. AGENDA APPROVAL
Kenyon moved approval of the Agenda. The motion was seconded.
There was no discussion.
The motion carried unanimously upon vote with Olson absent.
B. CONSENT AGENDA APPROVAL
1. Council Minutes — Re ular Meetin — bruM 5 2007
2. Violence Against Women and Domestic Violence Intervention Grants
These are pass -through federal grants for a domestic violence education and accountability
officer and ankle bracelets to track misdemeanor offenders.
3. Ordinance 1598 — Initial Zoning — James & Pegay Mathiason — 2nd Readin
James and Peggy Mathiason have requested a zoning designation of R-3, Urban Single
Family Residential, on approximately two acres located on the east side of Valley View
Drive. Ordinance 1595 passed unanimously on first reading February 5.
4. Ordinance 1599 — Planned Unit Devel,ol2ment Overly — Resubdivision of Lot 1 of Minor
Subdivision Plat Number 117 — 2nd R.eadin
The property proposed for the PUD overlay consists of approximately four acres along
Denver Avenue. Ordinance 1599 passed unanimously on first reading February 5.
Atkinson moved approval of the Consent Agenda. The motion was seconded.

C. STUDENT ISSUES

D. PUBLIC COMMENT
Barney Stucker, Bigfork, stated he represents the Stop Underage Drinking in the Flathead Coalition
and they want to stage a finishing event for a young man who died of alcohol poisoning called
"Kevin's Last Stop" in Kalispell. He said Kevin" s father is walking from Gilbert, Arizona to
Kalispell with his son's ashes in order to raise awareness of teenage drinking. He asked for Council"s
support and participation in the event, which is scheduled for July 1.
Myrna Terry, 1505 whalebone Drive, commented that Terry Construction has been trying to build
affordable housing in town for 13 years and the price of their homes has doubled due to various
reasons including the cost of land, the increase in connection fees, and the hoops developers have to
jump through. She encouraged Council that prior to making decisions they consider what the effects
of those decision will have on affordable housing.
E. PUBLIC HEARING — STORMWATER REGULATIONS
Comments were requested concerning new stormwater regulations for the City of Kalispell.
Mayor Kennedy opened the public hearing.
Myrna Terry, 1505 whalebone Drive, stated she has reviewed the regulations as a builder on small
lots. She said Terry Construction has been following most of the regulations anyway, but there are a
few areas of concern such as erosion and sediment control. Terry stated some of the regulations
could be expensive for small builders and asked that informational mailings be sent out to
developers.
Mayor Kennedy closed the public hearing.
F. REPORTS/RECONIlVIENDATIONS AND SUBSEQUENT COUNCIL ACTION
F11, ORDINANCE 1 — STORMWATER REGULATIONS — FIRST READING
This resolution adopts stormwater regulations that comply with Federal and State stormwater
permitting requirements.
Kenyon moved first reading of ordinance 1600, an ordinance regulating and controlling the
design, construction, use, and maintenance of any development or other activity which
disturbs or breaks the topsoil or results in the movement of earth on land in the City to comply
with the NPDES Phase II Stormwater Program of the Environmental Protection Agency as

administered by the Montana State Department of Environmental (duality and declaring an
effective date. The motion was seconded.
Harball explained the amendments and clarifications that were distributed just prior to the meeting.
Turner gave a staff report and answered questions.
Kennedy echoed Terry's concern that the erosion and sediment requirements will negatively impact
the availability of affordable homes.
Hafferman stated he has contacted some of the developers in the area and he is concerned that the
public has not had sufficient time to ask questions and make comments.
Hafferman moved to table ordinance 1600 for one month and directed staff to send another
letter to the users asking for comments. The motion was seconded.
The motion to table carried upon vote with Gabriel, Hafferman, Kluesner, Larson, and Mayor
Kennedy voting in favor, Atkinson and Kenyon voting against, and Olson absent,
FI2. FINAL PLAT — GLACIER VILLAGE GREENS PHASE 18
This is a request for final plat approval of Glacier village Greens Phase 18 that plats 12 sublots on
approximately two acres located at the northern end of East Nicklaus Avenue.
Atkinson moved Council approve the final plat of Glacier Village Greens Phase 18. The motion
was seconded.
Conrad gave a staff report and answered questions.
There was discussion.
The motion carried unanimously upon vote with Olson absent.
G. MAYORJCOUNCILICITY MANAGER'S REPORTS (No Action)
Mayor Kennedy congratulated Baker and the Street Tree Commission for receiving the Street Tree
USA award for the 20th year and the USA Growth Award as well.
Mayor Kennedy distributed information from Flathead Care to Council and shared the results of their
survey detailing teen alcohol, drug, and tobacco use.
Mayor Kennedy invited everyone to a celebration at Red's Wines and Blues for Virginia Sloan on
Wednesday night from 4.30 to 6.30. She said Sloan, who has accepted a job with Senator Tester's
office, has dedicated many years of service to the citizens of Kalispell.

Larson stated the County 911 center was recently overloaded with calls, and our City dispatchers
stepped in to give them a hand. He commended the City's dispatchers for their willingness to help
out.
Patrick informed the public that there are a number of board vacancies coming up and asked anyone
who is interested to submit a letter of interest.
Patrick asked that anyone in Ward 2 who is interested in serving on the Council submit a letter of
interest by Friday.
