P,M., MONDAY, DECEMBER 18, 20069 IN THE COUNCIL CHAMBERS AT CITY HALL
IN KALISPELL, MONTANA. COUNCIL PRESIDENT DUANE LARSON PRESIDED.
COUNCIL MEMBERS JIM ATKINSON, KART GABRIEL, BOB HAFFERMAN, BOB
HERRON, RANDY KENYON, TIM KLUESNER, AND DANK OLSON WERE PRESENT.
MAYOR PAMELA B. KENNEDY WAS ABSENT.
Also present: City Manager Jaynes Patrick, City Attorney Charles Harball, City Clerk Theresa White,
Police Chief Frank Garner, Chief of Detectives Roger Nasset, Fire Chief Randy Brodehl, Finance
Director Amy Robertson, Community Development Director Susan Moyer, Housing Manager Lynn
Moon, Public Works Director Jim Hansz, Parks Director Mike Baker, Planning Director Tom Jentz,
and Recording Secretary Judi Funk.
President Larson called the meeting to order and led the Pledge of Allegiance.
A. AGENDA APPROVAL
Kenyon moved approval of the Agenda. The motion was seconded.
There was no discussion.
The motion carried unanimously upon vote with Mayor Kennedy absent.
B. CONSENT AGENDA APPROVAL
1. Council Minutes — Re lar Meeting.— December 4 2006
2. Award Bid — Meridian Trail Connector Pocket Park Post oned December 4
Two bids were received for the Meridian Trail Pocket Park located at the Kalispell Youth
Athletic Complex. Staff recommended the bid be awarded to Doepker Landscaping on a low
bid of $22,670.00.
3. ordinance 1596 — Initial Zoning.--- owl Cor oration — 2nd Readin
Owl Corporation has requested a zoning designation of R-3, Urban Single Family
Residential, on approximately 58.5 acres located immediately north of the West View
Subdivision along Stillwater Road. ordinance 1596 passed unanimously on first reading
December 4.
4. ordinance 1597 -- Initial Zonin - 93 & Church LLC — 2nd Readin Silverbrook Estates
93 & Church, LLC has requested zoning designations of R-Z Single Family Residential, R-4
Two Family Residential, and B-1 Neighborhood Buffer District, along with a Planned Unit
Development overlay on approximately 325 acres located 2.2 miles north of West Reserve
Drive along Highway 93 North. ordinance 1597 passed unanimously on first reading
December 4.

5. Retirement Reco ig�n tions
President Larson presented Community Development Director Susan Moyer and Chief of
Police Frank Garner with plaques for their many years of service with the City of Kalispell.
Both Moyer (28 years) and Garner (20 years) are retiring at the end of this year.
Atkinson moved approval of the Consent Agenda. The motion was seconded.
The motion carried unanimously upon roil call vote with Mayor Kennedy absent.

E. REPORTS/RECOMMENDATIONS AND SUBSEQUENT COUNCIL ACTION
EII. ORDINANCE 1595 — SUBDIVISION REGULATIONS — ZND READING
The City of Kalispell has requested amendments to the Kalispell Subdivision Regulations to address
legislative changes in the subdivision and platting act for review and processing of subdivision
applications. In addition, several definitions will be added and Appendix B will be revised with
regard to the information needed in an environmental assessment. Ordinance 1595 passed on an
eight -to -one vote on December 4.
Jentz gave a staff report.
Atkinson moved second reading of ordinance 1595, an ordinance amending the City of
Kalispell Subdivision Regulations codified at Chapter 28 of the Kalispell Municipal Code,
declaring an effective date, and authorizing the City Attorney to codify the same. The motion
was seconded.
Hafferman stated he is very concerned about the environmental assessment portion of the regulations
because it is "right out of the playbook of one of the collaborators". He said this is an important
document and the Council has not discussed the environmental portion, adding it's a "horrible piece
of writing."
Jentz responded that the purpose of an environmental assessment is to get important information to
City staff so that Council can receive the best recommendation the staff can give on a project, it's not
a place to take any shortcuts.

The motion carried upon roll call vote with Atkinson, Gabriel, Herron, Kenyon, Kluesner,
Olson, and President Larson voting in favor, Hafferman voting against, and Mayor Kennedy
absent.
F. MAYOR/COUNCIL/CITY MANAGER'S REPORTS No Action
Atkinson offered his congratulations to Moyer and Garner and thanked them for their years of
service and friendship.
Olson remarked that Moyer and Garner have definitely left their marks on the City.
Patrick also thanked Moyer and Garner, adding they will be sorely missed.
Patrick reminded Council of the Legislative Luncheon on Tuesday, December 19, beginning at 11:30
a.m. at Central School.
