11-28-16 City Council Work Session MinutesKALISPELL CITY COUNCIL WORK SESSION MINUTES NOVEMBER 28, 2016 View the minutes attached to the audio of the meeting at: http://kalispell.com/mayor and city council/Streaming_AV.php A WORK SESSION OF THE KALISPELL CITY COUNCIL WAS HELD ON MONDAY, NOVEMBER 28, 2016, IN THE COUNCIL CHAMBERS AT CITY HALL IN KALISPELL, MONTANA. MAYOR MARK JOHNSON PRESIDED. COUNCIL MEMBERS JIM ATKINSON, SANDY CARLSON, KARI GABRIEL, CHAD GRAHAM, PHIL GUIFFRIDA, TIM KLUESNER, ROD KUNTZ, AND WAYNE SAVERUD WERE PRESENT. Also present: City Manager Doug Russell, City Attorney Charles Harball, Planning Director Tom Jentz and Planner H PJ Sorensen. Mayor Johnson called the work session to order. DISCUSSION ITEMS 1. Short Term Rentals (Vacation Rentals By Owner) Everyone being familiar with the issue, Kluesner proposed eliminating condition 3 and adding a limit of 200, or approximately 2% of residences, as a manageable and enforceable number of short term rentals within the city in the residential zones. There was discussion. Jentz answered questions. There was further lengthy discussion. The matter will be on the next council meeting agenda. Public Comment Cliff Harshbarger of Sherwood Lane remarked council is trying to take away some of the rights and privileges of being a homeowner; he suggested leaving rules up to Homeowners' Associations. Erica Wirtala, representing the Association of Realtors, commented they agree with a percentage cap on the number of units and that having Homeowners' Associations regulate these would be a disadvantage because they would have to file civil suits. Lisa Harshbarger of Sherwood Lane stated her neighbors have never complained about their VRBO and she does not understand why regulation is needed for this. Scott Lester, 611 6th Avenue West, commented it is good for the downtown zones to have more short term rentals and discouraged council from capping them. He said they are good for the city in the long run and are better than long term rentals.
