RESOLUTION N APPROVING THE REVISED PRELIMINARY PLAT OF THE HERITAGE BANK LEASE SITE, LOCATED IN THE SOUTH HAP OF THE SOUTHEAST QUARTER OF SECTION 7, TOWNSHIP 28 NORTH, RANGE 21 WEST, .M.M,, FLATHEAD COUNTY, M NTANA. WHEREAS, Red Lion n Hotels Limited Partnership and GVD Commercial Properties, Inc., the owners of certain real property described above, has petitioned for approval of the revised preliminary plat of said lease site, and WHEREAS, preliminary plat approval for this minor subdivision was rai Sv d on June 30,2006, by the Kalispell Planning Department artment according rdin to Section 2.06 of the Kalispell Subdivision Rnlatins subject to five conditions, all of which have been met, and zn WHEREAS, the proposed subdivision Plat of said property is subject to the provisions of Section 2.06 (Preliminary Plat Process -Minor Subdivision -Preliminary Plat Waiver), Subdivision Regulations of the City of Kalispell, and WHEREAS, Chapter 4 of the Kalispell Subdivision Regulations require any tract of land being divided for the Purpose or renting or leasing a Portion thereof be subject to subdivision review, and WHEREAS, the Kalispell Planning Department has reviewed the Proposed subdivision and made a report KWP-06 -5 to the City Council of the City of Kalispell, said report considering the criteria set forth in Section 76-3-608 MCA, and recommends revised Preliminary plat approval of said lease site. NOW THEREFORE., BE IT RESOLVED BY THE CITY COUNCIL THE CITY OF KALISPELL, MONTANA AS FOLLOWS: BEGIN I. That the Findings of Pact contained in Kalispell Planning Department Report KWP- -5 are hereby adopted as the Findings of fact of the City Council. SECTION II. That the application of Red Lion n Hotels and GVD Commercial Properties for revised preliminary plat approval of the Heritage Bank lease Site in. Section 7, Flathead County, Montana, is hereby a -roved. SECTION 111. The classification of said premises -under the Kalispell Zoning Ordinance shall not be changed by the action.
