09-12-16 City Council Work Session MinutesKALISPELL CITY COUNCIL WORK SESSION MINUTES SEPTEMBER 12, 2016 View the minutes attached to the audio of the meeting at: http://kalispell.comlmayor and city_ council/meetings.php A WORK SESSION OF THE KALISPELL CITY COUNCIL WAS HELD ON MONDAY, SEPTEMBER 12, 2016 IN THE COUNCIL CHAMBERS AT CITY HALL IN KALISPELL, MONTANA. MAYOR MARK JOHNSON PRESIDED. COUNCIL MEMBERS JIM ATKINSON, SANDY CARLSON, KARI GABRIEL, CHAD GRAHAM, PHIL GUIFFRIDA, TIM KLUESNER, ROD KUNTZ, AND WAYNE SAVERUD WERE PRESENT. Also present: City Manager Doug Russell, City Attorney Charles Harball, Planning Director Tom Jentz, and Planner H PJ Sorensen. Mayor Johnson called the work session to order. DISCUSSION ITEMS General Public Comment None. Zoning for Short Term Residential Rentals (VRBOs - Vacation Rentals By Owner) Russell reiterated the previous work sessions on the topic and turned the discussion over to Sorensen. Sorensen described some of the changes and suggestions that council and staff desired to see in the ordinance and said that parking is an issue of concern. He remarked that a tracking service is very important to have and would require a yearly fee of $75 per permit to cover the cost. Guiffrida requested an explanation of the parking regulations. Sorensen and Jentz explained the regulations and answered additional questions. Guiffrida commented the city needs to focus on standardization and consistency and to be aware of any unanticipated consequences regarding other types of uses. Jentz remarked the city does not want an ordinance that creates more problems than it solves. There was further discussion regarding parking and subletting of rental properties. Mayor Johnson remarked he would rather leave it up to the free market economy. Kalispell City Council Work Session Minutes September 12, 2016 Page 1 Public Comment Dan Sheppard, representing the residents of Village Greens, asked additional questions regarding issues mentioned already and requested that council prohibit their subdivision from VRBOs. Fred Zavodny, 46 East Nicklaus Avenue, spoke regarding the stability of the neighborhood; he said this is a residential community which is quiet, safe, and comfortable. He said allowing VRBOs would result in a transient component and requested that council exempt Village Greens from allowing VRBOs. Janet Clark, Kalispell Grand Hotel and TBID Board, remarked she wants to bring more people into town and she is all for free market commerce as long as VRBOs are competing on the same level as they do, e.g., bed taxes, inspections, and paying employees including benefits. An unknown speaker thanked council for listening to public comment and taking their time on this issue, but questioned if this issue has come up because a harm had come to the public. Vanessa Ross explained how her short-term rental works and asked council to address long-term rentals as well. Council consensus was to bring an ordinance before council with additional information in the near future. 2. Hours of Operation related to Noise Ordinance Russell introduced the topic. Harball answered questions about the Disturbing the Peace ordinance, noting it has not been updated in a very long time. There was discussion. Council directed staff to clean up the language of the ordinance and bring it back at a future meeting. Public Comment Janet Clark, Kalispell Grand Hotel, remarked the most frequent complaint they receive is the noise coming from Main Street, particularly on Friday nights, with people revving their engines and playing loud music.
