.A RESOLUTION OF INTENT To SELL AN ENCROACHMENT EASEMENT ONTO
BUFFALO .ILLS GOLF COURSE AND CALLING FOR AND FIXING A DATE FOR A.
PUBLIC IC HEARING AND DIRECTING THE CLERK TO PUBLISH NOTICE OF THIS
INTENT AND HEARING.
WHEREAS, the City o Ka ispell owns Buffalo Hills Golf Course, a public golf course located
at the end of North Main Street; and
WHEREAS, the City has received a proposal from.. r. Daniel .Abbott requesting that the City
sell him an encroachment easement of 406 square feet onto Buffalo Hills Golf
Course, as further described in Exhibit """'; and
WHEREAS, state law ,requires that a public hearing be conducted to collect testimony and
evidence, f any, regarding the sale of the easement and that such public hearing
be publicly noticed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY of
KALISPELL AS FOLLOWS:
SECTION 1. .A public hearing shall be conducted at City Council Chambers, 312 First
Avenue East, Kalispell, Montana at 7.00 pm, June 19, 2006 for the
purpose of collecting testimony and evidence from the public regarding
the City 's intent to sell an encroachment easement onto Buffalo Hills Golf
Course, as further described in Exhibit "A"'. Subsequent to the conclusion
of said hearing the City Council, after considering all spoken and written
communication, may adopt a .resolution approving the encroachment
easement of the subject City oval property.
SECTION 11. The City Clerk is authorized and directed to give .notice of said bearing in
accordance with Section 7-1-413 , Montana Code Annotated.
