Whereas, it is the sense of the majority vote Of the
City Council of the City of KalispellJontana, that it is necessarry
for sanitar7 purposes that a sewer be constructed in the alley in
W
Block One Wdred Forty-three (143) of the original townsite of
Kal isp 0 1 , Yon tana .
Be it further resolved that it is the intention of said
City Council to crenV� a -nc�w Special Improvement District to be
known as Special Improvement District No. 49 for th; purpose of
constrvcting an eight inch lateral sewer th9rein. The boun6ary
of said Special inTroysment District shall include all tAe lots in
said Block 1434 Said Improvement District above described to be Am -
proved b7 constructinr said eight inch lateral sewer, beginning at
a point in the cente, of Twelfth Street and extending North through
the center of the alley in said Block 143 to the ow er of Eleventh
Street and there to connect with the main sewer Wfetofore con-
structed.
Said Sewer to be constructed of vitrified sewer pipe
under the supervision of the CAV Engineer. Thu aprroximate cost
of said sewer being the sum of Pour Wndred Dollars ($400.00) and
the sam.e slill be paid by special assessment upon all the assess-
able property within said Special Improvement District, exclusive
of Streets, alleys and public plAces; and each piece or parcel of
land within said distr dct shall pa7 that proportion of the Ast
of said improvement as the area thareof bears to the area of the
entire district, exclusive of streets, alleys and public places.
Be it further resoled that notice be -published In the
Kalispell Jonrnal for at 1; ast one issue for the full time required
by Isw the-efor. Said KaIispell Journal beiqS a newspaper or gene-r-'I
circuli iion in Ahe City of Kalispell, Montana, givine notice of the
intention on the part of the said City Council to make said im-
provements notifying all owners or nEents of thp pnop,A7 within
said Special InVrovement District0o. 49 to be affected or bene-
fitted thereby, that the said City Council of the City of Kalispell
will meet on the 25 dqr of May 1909 at 8 o'clock P.M. in the Council
Obambers at the CA7 Hall in Kal isp ell Montana,' at -,-;hicla t:Lme any
owner oragent of ths p"operty affected thereby may appear and pro-
test against the final establighment of said district.
It is further ordered by the City Council that all assess-
ments levied aEainst the property within said Special Imrrovement
District No/ 49 shall be paid in three equal installmenti or pay-
ments, ths first of which shall bo paid in the yeAr 1909 and all
deferred payments to bea4 interest at the rate of six per cent per
annum, payable annually.
