PERFORMANCE BOND REMINDERS:
Spring Prairie - Phase 4: Haskins stated we have not accepted their bonds yet. We need to cover
non -accepted items under their Performance Bond, even if they are installed but not accepted. We
will need a Warranty Bond for items that have been accepted. Jentz stated their engineer will need to
determine what is left to do. They will have to know in two weeks for the Final Plat.
OLD BUSINESS:
Shops Building (Outlot D) — Spring Prairie Phase IV — at the corner of Old Reserve and Hwy 93.
Sorensen noted this went to ARC again and has still not passed, but they are making progress. They
moved down some of the handicapped spots and moved the garbage collection area. There was some
discussion with the architect for Krispy Kreme and the architect for Shops regarding the possibility of
having some kind of joint garbage collection there. It was not rejected, but it did not seem like it
would function well. Haskins asked if there was any discussion on the handicapped ramp on the west
side. Sorensen did not think so. Haskins has included it in his comments, but has not received
anything back yet. Parker is done with his review. Sorensen has a couple of details under zoning,
and Fincher has not received all the landscaping information. Jentz added that the ARC Committee is
asking, since it is now flat earth and a major intersection, where's the prominence, the entrance, the
focal point ... where's anything going? There's nothing to say, `This is great.' There is a mattress
store and a Mexican Food Restaurant going in this building. The raised, concrete planter was
discussed. Freyholtz stated the ROW landscaping plans may be completed by MDT review by next
week. Blumenstein wants this on the agenda for June 6th. This will continue to be on the Site Review
agenda.
Krispy Kreme — Spring Prairie 4. This did go through ARC. The plans show the connections we
had asked for. Their enclosed garbage collection area is about four feet from the sidewalk. They can
make it a little bit smaller by sliding a few things and get it about four feet further away. They will
work on some striping and signage to help with traffic on their lot. Nygren noted that any crossing is
supposed to be colored concrete (red), not colored paint, according to the PUD. They also look like
they step down. Haskins will include this in his comments. They will not be able to begin their
project until Spring Prairie Phase 4 is Final Platted. They are hoping to pull their permit on June 7th
This will be on the agenda for next week.
Buffalo Hill Terrace (Immanuel Lutheran West Campus) — 40 Claremont, Phase IA & 2;
expansion of existing retirement facility. Regarding their bike path, they are supposed to provide a
bike path easement. The path needs to have a buildable easement. The easement needs to be
provided prior to any building permit on the west side of the campus. The State won't take a project
that doesn't have ROW in place. Jentz suggested we put it back on them and require they give us the
easement now, and it needs to be a legitimately buildable easement that connects to the existing
intersection. They need to give us the route and then we can approve it. MDT will allow it. Haskins
noted that Morrison-Maierle is doing the site work. Parking was discussed. This will be on the
agenda for next week.
Papa Murphy's — 2 3rd Avenue E; new building to replace existing building on lot. This has been
submitted for ARC. Kramer noted last week that they are shifting the site around a little bit, but they
have not submitted any revisions yet. It was noted that the existing site has always been accessed off
the alley, with exits making a right-hand turn onto Third (one-way). Jentz noted that this is the
highest volume Papa Murphy's in the state. These changes will double the size of the lot. This will
be on the agenda for next week.
Northwest Family Medicine — 70 Village Loop; new family practice medical office. Haskins started
his review on this today. McIntosh stated last week that the building is in the 8,200 sq. ft. range,
single story. This will be on the agenda for next week.
Blanchard Dental — Commons Loop; office building. Liechti is present for this project. This is
across from Glacier Bank. This is a two-story commercial space for medical offices. The dental
clinic will be on the upper floor. Wargo is reviewing this, but there are some questions on the
hydraulics on the stormwater side of it, so we are trying to figure that out so we can get questions
back to APEC. The PUD up there requires the pathway. We had discussed last week trying to do a
trail connection and also leaving a little bump -out for a turnaround. Liechti stated they have asked
the owner and the owner does not have a problem with it, as long as they can make the trail
connection without having to build a whole bunch of retaining walls. The grade is pretty flat.
Sorensen asked that whatever the revisions are that will show that, we would like to get those. The
review will continue on this. Liechti stated the building plans are coming in soon. This will be on the
agenda for next week.

NEW BUSINESS:
Ray of Hope — We have talked with them previously. This is for a large, single family house across
the street to the south from the existing Ray of Hope house on 5th Avenue W.N. The new facility will
be a Women's and Children's facility. The handicapped ramp and parking were noted by Sorensen.
Parker is reviewing this as a single family home.
KRMC Day Care — request for an administrative conditional use permit to remodel an existing
previous office on Burns Way and convert it into a daycare for KRMC employees. All the parking is
there, and they are not adding on to the building. We will require sidewalk along the south side along
the curb with a handicapped ramp to the road. Public Works will need to see some details regarding
this. This facility will provide care for 64 children.
PLANNING OFFICE ITEMS:
61h Street West — There is an old house to be demolished, and they will be putting four townhomes
there. They are coming in for their CUP. The zoning is R-4. There are storage/mechanical rooms
between the units to adjoin them. This will be on the June Planning Board Agenda.
OTHER REPORTS:
VRPOs — Jentz noted the City Council is still pursuing the short-term rental vacation units in terms of
what to do with them, including possible life -safety fire inspections.
Captain's Marine — They have a Letter of Credit for a number of things that they didn't complete.
An updated layout was viewed. They added some paving in an area that wasn't provided for before.
One of the big issues is there is a question about where the actual ROW line is. What the PUD called
out was that the bike path was supposed to be in the ROW, right on the ROW line. Freyholtz stated,
"It looks like it's outside of the ROW, and I see it is paved down there now. They never came to us."
Sorensen stated that what is shown on the drawing is that it is outside of the ROW. Roger Porch is
hiring someone to go out there and shoot the end, so we'll see what they wind up with on that. Right
now the indication is that it is a 10-ft. bike path with about 3 t/2 feet of it is on private property and
about 6t/2 feet of it is in the ROW. Haskins noted there is a lathe in the fence on the south side of
their property that said "point on ROW". If that is on the ROW line, then they are mostly inside the
ROW. Options were discussed. We could require a 3 t/2 foot dedication of ROW, but weren't sure if
that would be better than an easement. Freyholtz stated that this will take some discussion with his
fellow MDT employees. They should have gotten an encroachment permit from MDT to put
anything in there. It looks like it goes up to their southern property boundary, so what will happen to
it in the future. The plan that attached to the building permit showed all landscaping in there, with
some paving shown to engineering. They actually paved about 1,500 sq. ft. more than what they
showed. It's similar to lighting, because they put in the lighting differently than what the plans were.
They will have updated plans and we will review them as amendments and they may work out fine or
they may not. They will be putting in more landscaping. They also put up their sign without a permit;
it's over height, but it is over the bike path by about a foot (+ or -). There is also a standard from a

trail to an obstacle beside the trail as to how close that can be. We also need to check into that. They
assumed that they didn't need a permit because it was already existing in the County and didn't ask.
Porch wants to get his Letter of Credit released to pay their subcontractors. He feels they are done
with all of it. Sorensen stated to him that they finished it, but they didn't do it according to the plans.
Haskins stated that the engineering plans showed the fire hydrant right at the edge of the ROW.
They have their C of O, with their Grand Opening this weekend. We will try to resolve the problems
as soon as we can, and are waiting for a number of items from Chris from Porch on this. They will
need to do a retro-active encroachment permit with MDT if they are in MDT's ROW.
