and is hereby required, in accordance with theorrovisions of
Ordinance No. 21 heretofore passed, to extend As water mai;j as

BE 1T RESOPJA BY TEE CITY MYCIL OF THE CITY OF KALISPELL:
Qat the Kalispell Water & Biectric Company be reqVired, and is
heraly required, in ancordance with the provisions of Ordinance Yo.
21 heretofore passedl to extend its water mains as follows: --

Beginning at the extension of the water main heretofore ordered
by the City Council oh Yontana Street, at the intersection of said
street with Fourth Avenue West, and running thence South on the East
side of 3ourth Avanue West to the intersection of said Fourth Avenue
West with Railroad Streets a di2tance of one block.
Beginning at the end of the prevent water main at the intersec-
tion of Seventh Street and Firot Avenue East and running thence Sout'a
along the West side of said YOH Avenue Eaot to Eighth Street, a
distance of one block.
Beginning at the present water main on Ninth Street at the in-
tersection of said Street with Second Avenue West, and running thenne
South along the West side of said Second Avenue West to Tenth Street,
a distanze of one block.
And permission is hereby given the Kalispell Water & Electric
Company to use wooden pipe wrapped with wire and of the same con-
struction, etc. as heretofore used in the extension of mains in the
City of Kalispell.
Be it further resolved, that the City Clerk be directed to serve
a copy of this resolution together with an order requiring the exten-
sion of said mains as above set forth,upon the HAlispell Water &
Electric Compa�ly.

ric-an Buckizgh-wln, that said Resolution be passed. Motion carTied by
the foliowing vote: Buckingham, Bienz, Dickey and Schumann, Aye;
no Noes.
The Committee on Streets and Alleys reported on an application
of Philip Jacoby, for a pernAt to erect a clock upon Main Street,and
recammanded that the application be denied. it was moved by Alder-
mar.Buokingham and seconded by Alderman Dickey that the report of the
Cannittee A Streets and Alleys be accepted. Motion caxried.
It was thereupon moved by Alderman Bienz, seconded by Alderman
Buckingh=2 that no fire -crackers be permitted to be used or fired
in the City of Kalispell on the Fourth of July, any laxger in. size
than No.
Alderman Child presented the follaving motion: That the City
Clerk advertise for bids for cement walks, as soon ax the specifi- '.
cations were completed, bid to be accompanied by a check for $500;00,
as a guarantee that he will enter into a contract to construct not
to ezveal 250,000 square feet of Cement Walk for the season of 1909;
that a bond be given that shall be satisfactory to the City of Kal-
ispell in the sum of $5000-00, as a construction bond and three-
year maintenance bond of 590 of the coFt of the work.

foilowing Ordinance for passage:--

P7LL, AND REPRALING ORDINAECE NO. 109, PASSED kaD APPMED MAY 4th,
1909.
BE 1T ORDAIYZD BY THE CITY COUNCIL OF THE CITY OF KALI SPEIL,HON TANA;
Sec.l. The running at large of dogs upon the streets, avenues,
alleys, parks or public grounds on the City of Kalispell is hereby
prohibited and declared to be a nuisance.
Sec.2. it is the duty of the pov;ndmaster to take up and impou&

any dog running at large contrary to any provision of this ordinance.
Sec.3. It'is unlawful for arty person to own, keep or harbor any
dog, role or f anale, which by loud And frequent barking, howling or
yelping, or by any other manner or way, cause annoyance or distur-
bance to arF person in this City.
Sec.4. Wenever affidavit be made before the police magistrate
of the City, that any dog has bitten a person, or any animal, in said
City, 4nd that the person so bitten was not at the time possessor of
said dog, the police magistrate shall issue an order directing the
owngr or possessor of said dog to kill it within twenty-four hours
after receiving sash order. The owner or posseasor who 5hall refuse
or neglect to kill sail dog within twenty-four hours after receiving
sunh order shall be guilty of violating this ordinanne, and it shall
be the duty of the pounWaster forthwith to kill or destroy said dog.
Se .5. The Mayor shall appoint sQme suitable person. as poundmuster,
and said poundmaster shall, at the expense of the City, provide a
suitable and retired place for the impounding of dogs; the location
of the dog pound shall be published in the newspqper in which the
ordinances of the City are published, or posted in the United States
Post -Office in the City.
Sec. 6. No person 8hall break open or injure the City pound, or
in any manner aid or advise the breaking, opening or injuring of the
City pound, nor shall any person hinder, delay or obstruct any offi-
cer while engaged in taking to the City pound any dog li"ble to be
impounded under the provisions of this ordinance. The word "dog''
includes both male and female, and the lord npound" includes the City
dog pound.
Sec.7. it is the duty of the pound -master to impound every dog
running at large contrary to any provision of this ordinance, If enn
impounded dog be not redeemed within forty-eight hours after said

dog is impounded, the poundmaster shall offer theimpounded dog for
sale at, public auction without notice, and if no bids to the amimt
of two dollars ($2.00) be received therefor, the impounded dog ahall
be killed by him, provided any person may redean an impounded dog
on payment of two dollars ($2.00)) to the pound -master. The pound -
master shall be..paid One dollar ($1-00) for every dog impounded and
killed by him, or One dollar ($1.00) for every dog Impounded arA re-
deened.
Sec.B. The poundnaste.- shall -have general supervision of the City
dog pound, and shall see to it that the sa-me is conducted in a quiet2
reliable �tnd proper zrianner. The provisions of this ordinance shall
not apply to any dog while being led,:by a chain or other suitable
f as t ening.

Sec..10. The mEmbers of the police force of the City shall have the

Schumann, that the Purchasing Agent be instructed to hams repairs
made to the City Hall. Motion carried unanimously.

Health Officer, Dr. Lamb, in attending the meetinE of the State 3oard
