BE IT RESOLVED BY THE CITY COUINICIn OF THE CITY OF KALIS- PEIL: That it is the intention of said City Council to create a rew Special Improvement District, to be khnwn as Special im.- provenryt District No. -43, for the purpose of improving the avenues therein, to establish grades, curbs and cons truct grass plats, sow grass seeds and plant trees th Win, arA to grade the alenues therein, the boundaries & which said Special Improvement Distrl:t are to be as follows, towit: Beginning wher6 the north line of the Great' Northern Railway Companyts right of way intersects the center of thie, alley between Fifth and Sixth Avenues West, thBnce North along the conterline of tht said alley to a point where thn s one inter- seots tip center line of Idaho Street; thence East along U-0 center line of said Idaho Street to a point whzere the same inter- sects a continuation of the center line of tA alley between Fourth and Fifth Avenues West; thence South along the ceN er line d? said Alley to a point where it inte?Acts ths North line of said Railwav rleht-of-way; thence West alonS sai6 North line of said right-of-way to tha place of beginning. Said Special improvemeit District herein above described to be improved as follows: By establishing a grade upon said Fifth Avenue West within the limits above described, constructing curb within said bounda- ries on both sides of said Avenue, groveling, grading and boUev"rding the same, swaing grass seeds and planting trees in the grassplats, grading up the center of said Avenue between said curbs, Chich said curbs shall be eighteen (18) feet from the property lines, bringing the Avenue to grade and placing grass! thereon, giving it a rcanded and amooth appearance and surface, also by establishing and putting in crossings wherever the same way be necessary. Ee it further resolved that notice be published in the Kalispell journal for at least one insue,for the full time required by law therefor, said Kalispell Sournel being a nawspaper of general c irculaticn in zaid City of Kalispell Sontana , giving notice of the intention on the part of said City Coancil to make said improvements, notifying all owners or agents of the property within said Special Improvement District W.43 to be af- fected or benefitted thereby, that said City Council of the City of Kai- ispeil; will meet on the --day of May, 1909, at 8 o'clock P.M., in the Council Chanbers at the City Halli Kalispell Montana, to ccnsider any ob- jections to the final establiWent of said Special Improvemert District, which said objections must be written and filed with the City Clerk an or before said date. It is further ordered by the City Council, that all assessments levied against said propEwty within WLd Special Zmprovetent District No. 43, shall be paid in three equal installments or payments, the first of which shall be paid in the year 1909, and all deferred paymento to bear interest at the rate of six per cent. per annum, payable annually. CC motion of Alderman Buckingham, seconded by Alderman Bienz, the City Clerk was authorized to purchase a Minute Book for the purpose Q recording the minutes of the City Council. It was moved by Alderman Bienz and seconded by Alderman Buck- ingham that the City Treasurer be authorized to amploy sane suitable per- son to camplete an index for the Special Improvement Districts of the City. The Mayor at this time appointed George Young custodian of the property belonging to the Xalispell band; said appoirrtment. on motion duly made and seconded was confirmed by unanimous vote. At this time a petition by numerove property owners of the City of Kalispell was presented to the City 06uncil, asking that their action granting the O'Neil Lumber 1"mber Company a permit to construct a wooden building on Main Street, be rescinded.
