Resolution 225 - SID 44M A RESOLUTION TO ESTABLISH SPECIAL IMPROVEMENT DISTRICT NO. 44. BE IT RESOLVED BY THE CITY COT MICIT, 01? THM CITY OF KAIIS- PRT'T': That it is the intention of said City Council to croate a new Special I%Mrovement District to be known as Special Im- provement, District No/ 44 for the purpose of Improving th.eAvenues therein, to establish grades, curbs and construct Erass Plats, sow grass seeds anj plant trees therein, and to Erade the avenues therein, the boundaries of Which said Special Improvements Dis- tricts are to be as follows, to -wit: -- Beginning at a point where the bo"ndary.lin, between Lots 3 and 4 in Block 104 intersects thn center line of the Alley be?,-,, tween Third and Pourth Avenue Hastj thence South in tie center of said Alley to a point where said center line intersect; the North line of! Twelfth street to a point where it intersects the center of the alley between Second and Third Avenues Past; thence Worth along the center line of the Allay betqyen said,Second and Third Avenue East to a point 4here it intersects the boundary line be- tween Lots 9 and 10 in Block 103; thence East alonE said line be- t wee n said Lots 9 and 10 in Block 103 and,Lots 3 and 4 in Blo&& 102 to the pla ce of beginning. Said Spacial Improvement District hrein above described to be improved as follows:- Byinxtablishing a grade upon said Avenue within the limits above describd, constructing curbs within said boundaries on both sides of said Avenue, macadamizing, grading and boulevarding the samej sowine grass seeds and plantl2r.,,g trees in the grass plats, grading up the center of said Avenue between said curbs, whlvh said curbs shallbe dghteen (18) feet from the property lines, bringing the Avqnue to Erade and plazing crushed rock thereon, eiving it a rounded an! swooth appearance and surface, and also by establishing and putting in crossings wherever the sane may be necessary. The approximate cost of s aid improvements is the sum of $3617.00, and the sane sh1l be paid by speciAl assessments upon all of the "ssessible property within said Special I"provement Distritt, exclusive of streets, alleys and public places, and each piece or parcel of land within said district shall pay that propa-tion of the cost of taid improvements as the area thereof bears to tho area of the Wire district, exclusive of s treets, all;Ts and public places, amounting to about $67?00 for each fifty foot lot. Be it Further Resolved that notice be published in thle Kalispell Journal for at least one issue, for the fulltins re- q"ired by law therefor, said Xalispell Journal being a newspaper of general cira lation in said City of Kalispelljontana, giving notice of the intention on the part of said City Council to make saiq improvements, notif7ing allowners or agents of the property within said Special I�naprove.r_rient District No. 44 to be affected or benefitted tl-ereby, that said City Council of the City of Kalis'- pell wi I meet on the 10th da7 of May, 1909, at 8 o'clock P,M., in the Council Chambers at thB City Ball, Kal ispell,21,ontana, to consider an7 objections to the final establishennnt I said Special JmDrovexent Distt ict, whicA said obys otions must be written and filed with the City Clerk on or before said date. . � It is furtAer ardered by the City -Council, that all assessments levied against said property within said Special Improvement District No. 44, shall be paid in three equal installments or payments, the first of -7:ihich shall be paid in tin year 1909, and all deferred pagnents to bear interest at tin rute of six per cent. per annum, payAh. e annually.
