PELL, TO BE KNOWN AS BIRK ADDITION #119 AND TO FIX THE DATE OF PUB-
LIC HEARING THEREON, TO PROVIDE FOR PUBLICATION OF NOTICE OF SAID
HEARING.
WHEREAS, Timothy R. Birk et al. has made petition to the City
of Kalispell for annexation to said City of certain territory to
be known as Birk Addition #119; and
WEEREAS, a preliminary plat thereof has been reviewed and con-
sidered in accord with the laws of the State of Montana and the
subdivision regulations of the City of Kalispell by the Kalispell
City -County Planning Board and said Board has, by cormnunication
dated Sept. 23, 1980 , recommended that said petition be granted
under certain conditions; and it appears that said conditions are or
will be adequately satisfied, and that it is to the best interest of
the city of Kalispell that said petition be granted,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF KALISPELL, AS FOLLOWSZ
1. It is the intention of the City of Kalispell that territory
comprising Birk Addition J119 shall be;annexed to the City of Kalis-
,pellf- and shall be classified a General Business B-3 classification
as I.,rovided by the City of Kalispell Zoning Ordinance. Said terri-
tory is more particularly described as follows:
A tract of land situate, lying and being in the
Northeast Quarter of the Northwest Quarter (NE14NW�4)
of Section Twenty (20), Township Twenty-eight (28)
North, Range Twenty-one (21) West M.P.M., Flathead
County, Montana; and more particularly described
as follows:
Commencinq at the North one -quarter corner of sec-
tion 20, Township 28 North, Range 21 West, P.M.M.,
Flathead County, Montana; thence
North 89144' West, a distance of 783.07 feet to a
point which is the true point of beginning of
the tract of land being described; thence
North 89044' West, and continuing along same line,
a distance of 268.93 feet to a point; thence
South 31'09'17" East, and along the easterly R/W
of the existing Hiway, a distance of 190.57 feet
to a point; thence
North 76'39' East, a distance of 203.10 feet to a
point; thence
North 13'21' West, a distance of 118.13 feet to the
place of beginning.
2. A public hearing on said petition for annexation will be
held by the Kalispell City Council at its regular meeting held in
the Council Chambers of the Kalispell City Hall. commencing at 7:30
P.M. on the 15th day of December, 1980.
3. The City Clerk will forthwith prepare and publish in the
Daily Inter Lake, a daily newspaper published at Kalispell, Montana,
proper notice of said public hearing. Said petitioner shall pay all
costs of publication of said notice.
