� RESOLUTION TO AMEND RESOLUTION #3309 TO AMEND THE PROPOSED BOUN-
)ARIES OF SPECIAL IMPROVEMENT DISTRICT -0329 AND TO PROVIDE FOR FUR-
PHER NOTICE AND HEARING ON RESOLUTION �3309, AS SO AMENDED.
WHEREAS, the Kalispell City Council did, on Sept. 22, 1980, pass
Resolution #3309, a.Resolution of Intention to Create Special. Im-
provement District 4329, and, pursuant thereto, Notice was duly given
to every person, firm, corporation or agent of the person, firm or
corporation having property within the proposed district and the
General Public of a public hearing on said Resolution 43309 to be
held by the City Council on October 27, 1980. Said public hearing
was &uly heldlin accord with the said notice given; and
WHEREAS, at said public hearing held on Oct. 27, 1980, the City
Council determined that further stud should be given to the proposed
aSS(!Ssment formula ordinance providedby Sec. 97-12-4165, M.C.A.,
prior to adoption thereof. The CiV Council continued the hearing
the�r_,eon pending such study. Further, the City Council determined
that ' certain amendments to the proposed boundary of said District 4
329 should also be studied before said District was created; and the
hea ' ring thereon was continued pending such further study of bounda-
ri,s; 'and
WHEREAS, further study by the Kalispell Parking Commission and
the City Council has apparently resolved existing errors and inequi-
ties in the proposed formula of assessment and have determined that
certain amendments should be made to the proposed boundary of said
Special Improvement District #329�j
NOW THEREFORE, be it resolved by the Council of the City of
Kal�spell:
SECTION I. Section 2 of Resolution #3309 is hereby amended to
read as follows:
"Section 2. Boundaries. The proposed boundaries
of Special Improvement District 4329
are as follows:
Beginning at the center line of the Burlington
Northern main line track which lies within the
Burlington Northern Right of way as shown on the
plat thereof for the city of Kalispell on file
with the Clerk and Recorder of Flathead County,
Montana, at the intersection thereof and the ex-
tended center line of 2nd Ave. East, thence west-
erly along the center line of said main line
track to its intersection with an extended center
line of 3rd Alley West, thence southerly along
the center line of said 3rd Alley West to the
center line of 4th Street West, thence easterly
along the center line of 4th Street West to the
center line of Ist Ave. West, thence southerly
along the center line of 1st Ave. West to the
center line.of 5th Street West, thence easterly
along said center line of 5th Street to center
line of 2nd Alley East, thence northerly along
the center line of 2nd Alley East to the center
line of 3rd Street East, thence �&"terly _�-Llong'
the center line of 3rd Street East to the center
line of 2nd Ave. East, thence northerly along
the center line of said 2nd Ave. East to the
point of beginning. Excluding therefrom the fol-
lowing: Lot 6, Block 377 Lot 3 and north -12 Lot
4, Block 33; Lot 14, Block 34-, and those lots
owned by the City of xalispell in Block 65(Lots I
through 12 of Block 65), and all public streoLs,
al
-loys, parks and public parking lots of the CiL--y
of Xalispell.
SECTION 11� All other portions of Resolution 43309 shall re-
main in full force and effect.
SECTION Ill. The City Council shall hear any protests or ob-
jections against the Creation of said Special Improvement District
#329 and the making of the Phase I and II off-street parking im-
provements in accord with said Resolution #3309, as amended hereby,
at a regular meeting of the City Council in the Council chambers
at t�e City Hall, 336 First Ave. East, Kalispell, Montana, on the

The City Clerk shall forthwith give Notice of said Hearing, as
provided by law.
