Resolution 3292 - Resolution of Intent & Notice of PH - Annexation - RoseglenRESOLUTION NO. 3292 A RESOLUTION OF INTENTION TO ANNEX TERRITORY TO THE CITY Or KALISPELL, TO BE KNOWN AS ROSEGLEN MANOR ADDITION 4118 AND TO FIX THE DATE OF PUBLIC HEARING THEREON; TO PROVIDE FOR PUBLICATION OF NOTICE OF SAID HEARING. WHEREAS, Carl Baltrusch has made petition to the City of Kalis- pell for annexation to said City of certain territory to be known as Roseglen Manor Addition #118; and WHEREAS, a preliminary plat thereof has been reviewed and con- sidered in accord with the laws of the State of Montana and the subdivision regulations of the City of Kalispell by the Kalispell City -County Planning Board and said Board has, by communication dated May 1, 1980, recommended that said petition be granted under certain conditions; and it appears that said conditions are or will be adequately satisfied, and that it is to the best interest of the City of Kalispell that said petition be granted, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, AS FOLLOWS: I. It is the intention of the City of Kalispell that terri- tory comprising Roseglen Manor Addition #118 shall be annexed to the City of Kalispell and shall be classified a Residential Apart- ment RA-1 classification as provided by the City of Kalispell zon- ing Ordinance adopted November 30, 1977. Said territory is more particularly described as follows: That portion of the Northeast quarter of the Northeast quarter (NEkNE-14) of Section 12, Town- ship 28 North, Range 22 West, Flathead County, Montana, described as follows: Commencing at the Southeast corner of the North- east quarter of the Northeast quarter,,Section 12; thence along the South line of the Northeast quarter of the Northeast quarter South 89'45'24" West 248.90 feet to the Point of Beginning; thence continuing along the South line South, 89045'24" West 635.72 feet; thence North 0'01'54" West 256.50 feet; thence North 89"54138" East 632.85 feet; thence South 0"140139" East 254.81 feet to the Point of Beginning. 2. A public hearing on said petition for annexation will be held by the Kalispell City Council at its regular meeting held in the Council Chambers of the Kalispell City Hall commencing at 7:30 P.M. on the 7th day of July, 1980. 3. The City Clerk will forthwith prepare and publish in the Daily Inter Lake, a daily newspaper published at Kalispell, Mon- tana, proper notice of said public bearing.
