Resolution 3280 - Resolution of Intent & Call for PH - Annex Opsand AddnRESOLUTION NO. 328.0 A RESOLUTION OF INTENTION TO ANNEX TERRITORY TO THE CITY OF KALISPELL, TO BE KNOWN AS OPSAND ADDITION NO. 107, AND TO FIX THE DATE OF PUB- LIC HEARING THEREON; TO PROVIDE FOR PUBLICATION OF NOTICE OF SAID 11 HEARING. WHEREAS, John Opsand and Ethel Opsand have made petition to the City of Kalispell for annexation to said City of certain territory to be known as Opsand Addition No. 107; and WHEREAS, a preliminary plat thereof has been reviewed and con- sidered in accord with the laws of the State of Montana and the sub- division regulations of the City of Kalispell by the Kalispell City - County Planning Board and said Board has, by communication dated July 26, 1979, recommended that said petition be granted under cer-. tain conditions; and it appears that said conditions are or will be adequately satisfied, and that it is to the best interest of the City of Kalispell that said petition be granted, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA, AS FOLLOWS: 1� It is the intention of the City of Kalispell that territory comprising Opsand Addition No. 107 shall be annexed to the City of Kalispell and shall be classified Residential R-4. Said territory is inore particularly described as follows: EXCEPTING the North 100 feet of the following described tract of land, A tract of land located in the SWkSEh, Section 1, Township 28 North, Range 22 West, M.P.M., Flathead County, Montana, more particularly bounded and described as follows: Beginning at the Southeasterly corner of Lot 11, Block 9, Sunset Addition No. 4; thence South 0104714611 West on and along the westerly line of Sunset Addition, a distance of 290.0 feet to a point on the northerly right of way line of Three Mile Drive; thence South 89'34141" West on and along said northerly right of way line a distance of 109.24 feet to a point which is the northerly right of way line of Garland Street; thence North 01047142" East on and along sa . id easterly right of way line a distance of 290.0 feet to the southwesterly corner of said Lot 11; thence North 89134141" East a distance of 109.25 feet to the point of beginning, Tract 2, Certificate of Survey No. 2133. EXCEPTING THEREFROM public roads and rights of way, 2. A public hearing on said petition for annexation will be held by the Kalispell City Council at its regular meeting held in the Council Chambers of the Kalispell City Hall commencing at 7:30 P.M. on May, 19 1980. 3. The City Clerk will forthwith prepare and publish in the Daily Inter Lake, a daily newspaper published at Kalizpell, Montana, proper notice of said public hearing. said petitioners shall pay all costs of publication of said notice.
