A RESOLULT-ON L=NG AND ASSESSING A SPECIAL ASSESSNoa AND TAX ON LOTS, PIECES

CON91-RUCTIIC SIDEWALKS, CURBS AND GUITERS ON PUBLIC STREETS IN rROW Or SAID
LOrS, PIECES AM PARCELS DUPING THE YEAR 1979
WfWXTM, the City Council has, from time to time in 1979 .., ordered
sidewalks, curbs and gutters, or combinations thereof, to be constructed on
�ublic streets within the City of Kalispell, according to the form and
procedure therefore prescribed by the laws of the State of Montana and the
ordinances of the City of Kalispell, and
MEP,EAS, said sidewalks, curbs and gutters, or combinations thereof,
were duly constructed as ordered and construction and other necessary costs
therefor have been paid by advances from the general funds of the City and/or
issuance of special warrants against the fund of the City of Kalispell known
as a "Special Sidewalk, Curb and Gutter Fund", and
WfIMEAS, said costs advanced and said special warrants, with interest
thereon at the rate of 7 % per annum should be paid by levy and assessment
thereof against the lot7s, -pieces and parcels in front of which said sidewalks,
curbs or gutters were constructed.
NGW THEREFORE, be it resolved by the mayor and City Council of the City
of Nalispell as follows:
To defray all the costs of said construction there is hereby levied and
assessed against the lots, pieces and parcels of land within the City of
Kalispell the charges as set forth opposite each of said lots, pieces or
parcels of4and, more particularly described on the attached Exhibit "A" which
by this reference is made a part hereof.
Said levy and assessment as is made hereunder shall also include accruing
intere�st at the rate of 7% % from the date hereof until paid, said sum and
accruc<3 interest due, may be -paid in equal annual installments spread over a
term ncA to exceed eight (8) years. The first said annual.payment shall be
delinuJont December,l, 19 80 � if not paid prior thereto and each succeeding
instal17',2nt shall become delinquent if not paid prior to December I of the year
same is, due.
Thc�� City Clerk is hereby directed to publish Notice hereof as provided by
Section 7-12-4177 M.C.A. This Council will meet and hear any objections to
said le,�y and assessment and take final action thereon at the regular meting of
the City Council at the Council Chambers, Kalispell City -Hall, commencing at
7:30 P,M. on the 5th day of May , 19 80 ; said Notice shall so pjovide.

RESOLUTION NO, 3284 (continued)
WHE13EAS, the within and foregoing Resolution No. 3284, signed by the Mayor
and Clerk of the Council of the City of Kalispell, Montana, was filed in the
office of said Clerk of the Council on the 21st day of April, 1980, and has since
that date been on file in said office, subject to inspection, and the Clerk of
the Council having given notice of the passing and filing of said Resolution by
publication in the Daily Inter Lake, a newspaper printed and published in the
City of Kalispell, Montana, at least five days before the date set herein for
hearing objections thereto, and the City Council having been in session at the
time and place for the hearing of objections, and no owner, or agent of any
owner of lots, pieces and parcels of land within the area wherein sidewalks,
curbs and gutters were constructed, or any other person, having appeared and
protested against or objected to the final passage and adoption of said
Resolution or to any assessment or tax hereby levied or assessed; and it appear-
ing to the satisfaction of the City Council that the cost of the construction
of sidewalks, curbs and gutters more particularly described on the attached
Exhibit "All was necessary and proper, and that the cost thereof should be assess-
ed accordingly as in said resolution provided;
NOW TEEREFORE, BE IT RESOLVED By THE COUNCIL OF THE CITY OF KALISPELL,
MONTANA, AS FOLLOWS:
That the 'within and foregoing Resolution No. 3284 be and the same is hereby
finally passed and adopted, and the said assessments therein provided for, and
all thereof, be and the same are hereby levied and assessed accordingly, and that
the first of said assessments are now due and payable to the City Treasurer of
the City of Kalispell, Montana, and same will become delinquent on December 1,
1980, at 5:00 P. M. of said day, and hereafter the annual payments as required
shall, become delinquent on the last day of November of the year for which said
annual amount is due at 5:00 P. X. of said day.
The City Clerk is also hereby ordered to deliver to the Kalispell City
Treasurer a eex-tified copy of this and the within and foregoing Resolution No.
3284 within two days after its passing.

EXHIBIT "A"
A tract of land in the SEkNW4 of Section 8, Township 28
North, Range 21 West, M.P.M., Flathead County, Montana, as
follows:
Beginning at a point which is 224.00 feet in an Easterly
direction from the Southeasterly corner of Block 2 of Duncan's
Addition to Kalispell, and on a line which is a continuation
of the Southerly line of said Block 2; thence running in an
Easterly direction and on a line which is a continuation of
the Southerly line of said Block 2, a distance of 142.00 feet;
thence running at right angles in a Northerly direction and
on a line which is parallel with the Easterly line of said
Block 2, a distance of 50.00 feet; thence running at a right
angle in a westerly direction and on a line which is parallel
with the continuation of the Southerly line of said Block 2,
* distance of 142.00 feet; thence running at a right angle in
* Southerly direction and on a line which is parallel with the
Easterly line of said Block 2, a distance of 50.00 feet to the
place of beginning.
Certain streets and/or public roads in the Southeast h of the
Northwest k of Sec. 8, T. 28, R. 21, more particularly des-
cribed as:
Eighth Avenue E.N. between the north boundary of California
Street and the south boundary of Oregon Street, not heretofore
lawfully annexed to the City of Kalispell and/or dedicated as
a public street; and
The West half of Ninth Avenue E.N.; and
The East half of Tenth Avenue E.N.; and
Oregon Street between the east boundary of Eighth Avenue E.N.
to the east boundary of Tenth Avenue E.N., not heretofore
lawfully annexed to the City of Kalispell and/or dedicated as
a public street.
