RESOLUTION NO. 3263
A RESOLUTION OF INTENTION TO ANNEX TERRITORY TO THE CITY OF
KALISPELL, TO BE KNOWN AS CIRCLE K ADDITION NO. 104, AND TO FIX
THE DATE OF PUBLIC HEARING THEREON; TO PROVIDE FOR PUBLICATION
OF NOTICE OF SAID HEARING.
WRRREA9 the Circle X Corporation and Platheaa County have
made petition to the City of Kalispell for annexation to said City
of certain territory to be known as Circle K Addition No. 104;
and .1
WHEREAS, a preliminary plat thereof has been reviewed and
considered in accord with the laws of the State of Montana and
the subdivision regulations of the City of Kalispell by the
Kalispell City -County Planning Board and said Board has, by
communication dated September 26 , 1979, recommended that said
petition be granted under certain conditions; and it appears
that said conditions are or will be adequately satisfied, and
that it is to the best interest of the City of Kalispell that
said petition be granted,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF KALISPELL, AS FOLLOWS:
1. It is the intention of the City of Kalispell that
territory comprising Circle K Addition No. 104 shall be annexed
to the City of Kalispell and shall be classified General Business
B-3. Said territory is more particularly described as follows:
A tract of land in the Southeast Quarter of the Southeast
Quarter (SEkSE4), Section Twelve (12), Township Twenty-eiqht
(28) North, Range Twenty-two (22) West, P.M.M., and more
particularly described as follows;
Commencing at the Southeast Section Corner of Section 12;
thence
south 8901614011 West 264.00 feet; thence
North 0*30' East 30.00 feet to the true point of beginning
of the tract herein described; thence continuing
North 0030' East 100.00 feet; thence
North 99'16'40" East 234.00 feet; thence
South 0*30' West 100.00 feet; thence
South 89016'40" West 234.00 feet to the true point of
beginning.
ALSO -
The westerly 20 feet of the Southwest Quarter of the South-
west Quarter (SWhSWk) of Section 7, Township 28 North, Range
21 West, P.M.M., described as being that portion of Meridian
Road as shown on the recorded subdivisions of Kalispell
Lumber Company Addition Number 27 to Kalispellf Walters
Addition Number 40 to Kalispell and Weismans Addition Number
48 to Kalispell, on file and recorded in the office of the
Flathead County Clerk and Recorder.
Also the easterly 30 feet of the Southeast Quarter of the
Southeast Quarter (SE34SEk) of Section 12, Township 28 North,
Range 22 West, P.M.M., and being that portion of Meridian
Road as shown on the recorded subdivision of Roy Stanley
Addition Number 42 to Kalispell and Certificate of Survey
Number 4405, on file and recorded in the office of the Flat-
head County Clerk and Recorder.

Also, that portion of the County Road known as "Meridian
Road" extending southerly from the above described two
parcels thereof to join the City Street known as "Meridian
Road" in the plat of Holister's Meridian Addition to the
City of Kalispell as filed and recorded in the records of
the Flathead County Clerk and Recorder.
2. A public hearing on said petition for annexation will
be held by the Kalispell City Council at its regular meeting held
in the Council Chambers of the Kalispell City Hall commencing at
7:30 P.M. on December 3 1979.
3. The City Clerk will forthwith prepare and publish in the
Daily Inter Lake, a daily newspaper published at Kalispell, Mon-
tana, proper notice of said public hearing. Said petitioners
shall pay all costs of publication of said notice.
