Resolution 3244 - SID 326 LevyRESOLUTION NO. 3244 A RESOLUTION LEVYING AND ASSESSING A TAX UPON ALL PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 326 TO DEFRAY THE COSTS OF MAKING THE SPECIAL IMPROVEMENTS AUTHORIZED THEREIN. BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA, AS FOLLOWS: To defray the costs of making the special improvements authorized in that area included within Special Improvement District No. 326 of the City of Kalispell, as more particularly described in Resolution No. 3168 dated May 1, 1978 and on file in the office of the City ClerV there is hereby levied and assessed against all said property a tax in the total sum of $ 75,000-00 plus interest as hereinafter provided. Said suffFlEc-ludes all costs of making said improvements and as allowed by Sections 7-12-4169, 7-12-4121 and 7-12-4122 MCA, and as certified to the City Clerk by the City Engineer upon completion and acceptance of said improvements. Said levy and assessment as is made hereunder against each lot or parcel of land within said district also shall include accruing interest thereon at the rate of 7.75 % until paid from the date or registration of bonds sold and issued in accord with Resolution No. 3182 dated July 7, 1978, and if same is not paid in full when so levied and assessed, said sum shall, with interest at 'iF 7.75 %, be spread over a term of not to exceed ten (10) yea _spayments to be made in equal annual installments as provided by Resolution No. 3182 dated July 7, 1978. Eacb lot or parcel of land within said district shall be assessed as follows: (1) The total costs of the construction of all streets, curbs and gutters within said project plus one-half (1/2) of the engineering and administration costs of said project shall be assessed in the proportion which the lineal feet thereof abutting or bordering upon a street in said district bears to the total lineal feet of lots and parcels within said district abutting or bordering on a street or streets within said district; (2) The total cost of the construction of water facilities and -sanitary sewer system attributable to said district plus one-half (1/2) of the engineering and administration costs of said project shall be assessed for that part thereof which the area of said lot or parcel bears to the area of the entire dis- trict, exclusive of streets, avenues, alleys and public places. The description of each said lot or parcel within said district and the name of its owner and the amount chargeable thereto in accord with the foregoing method of making and deter- mining the assessment and the amount of each partial payment thereof, including interest, and the dates when same shall become delinquent is set forth on Exhibit "A" attached hereto and which, by this reference, does become a part hereof. The City Clerk is hereby directed to publish Notice. hereof as provided by Sections 7-12-4176 (3), 7-12-4177 and 7-12-4178 MCA. This council will meet and hear any objections to said levy and assessment and take final action thereon at the regular meeting of the City Council at the Council Chambers, Kalispell City Hall, commencing at 7:30 p.m. on the 18th day of I June , 1979; said Notice shall so provide. Happ, Mayor"/ ATTEST: ba 7jWe--G---er4n,' �CZ�y �Cl�,k� he undersigned, City Clerk of the city of Kalispell certify that the foregoing is a true I ()f the Resolution duly passed by the City Council of the City of Kalispell, Montana at �galar meeting hel City Cle ; �the City of Kalispell WHEREAS, the within and foregoing Resolution No. 3244 r signed by the Mayor and City Clerk of the Council of the City of Kalispell, Montana, was filed in the office of said Clerk of the Council on the 4th day of June 1 1979, and has since that date been on file in said office, subject to inspection, and the Clerk of the Council having given notice of the passing and filing of said Resolution by publication in the Daily Inter Lake, a newspaper printed and published in the City of Kalispell, Montana, aL least five days before the date set herein for hearing objec- tions thereto, and the City Council having been in session at the time and place for the hearing of objections, and no owner, or agent of any owner of lots, pieces or parcels of land situated within said Special Improvement District No. 326 or any other person, having appeared and protested against or objected'to the Iinal passage and adoption of said Resolution or to any assessment or tax hereby levied or assessed; and it appearing to the satis- faction of the City Council that the cost of the improvements within the said Special improvement District No. 326 was necessary and proper, and that the cost thereof should be assessed accord- ingly as in said Resolution provided; NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KALTSPLLL, MONTANA: That the within and foregoing Resolution No. 3244 be anc-L the same is hereby finally passed and adopted, ___�_ndtF'e__said assessments therein provided for, and all thereof, be and the same are hereby levied and assessed accordingly, and that the first of said assessments are now due and payable to the City Treasurer Of the City of Kalispell, Montana, and same will become delinquent on November 30 , 19 79 , at 5:00 p.m. of said day, and hereafter the —annualpayments as required shall become delinquent on the last day of November of each year for which said annual amount is due at 5:00 p. . m 0-f—said day. The City Cleric, is also hereby ordered to deliver to the Kalispell City Treasurer a certified copy of this and the within and foregoing Resolution No. 3244 within two (2) days after its passing.
