RESOLUTION NO. 3237
A RESOLUTION CREATING SPECIAL IMPROVEMENT DISTRICT NO. 328
FOR THE PURPOSE OF DESIGNING AND CONSTRUCTING A SANITARY SEWER
COLLECTION SYSTEM, WATER DISTRIBUTION SYSTEM, AND STREETS
THEREUPON
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL,
MONTANA.
WHEREAS, on the 19th of — March 1979, said Council

intention to create Special Improvement District No. 328; and
WHEREAS, the City Clerk of said City did give Notice of
the passage of said resolution by publishing same for five
successive days in the Daily Inter Lake, a daily newspaper
published in Kalispell, Montana, beginning on April 15 , 1979, and
also on Apri119 _, 1979, true copies of said Notice were mailed to
all persons having real property within said district;.and
WHEREAS, on the 7th o f — May , 1979, at the next
regular meeting of said —Council'the Council did conduct a
hearing on said Resolution No. 328, and no protests, written
or oral, were made or presented against creating said Special
Improvement District No. 328.
NOW THEREFORE, said Council does hereby create Special
Improvement District No. 328 for the purpose of designing and
constructing a sanitary sewer collection system, water distribu-
tion system, and streets thereupon in that certain area
described as follows;
Those portions of Government Lots 3 and 4 of Section 6,
Township 28 North,, Range 21 West, M.P.M., Flathead County,
Montana, describe d as follows:
Commencing at the South Quarter Corner of Section 31, Town-
ship 29 North, Range 21 West, M.P.M., Flathead County,
Montana; thence
South 88138'58" West a distance of 1007.47 feet to the
Point of Beginning which point is on the South line of
Grandview Drive, a county road; thence along the South
line of the road
North 89038'44" West a distance of 631.95 feet; thence
South a distance of 157.26 feet; thence
South 36022'00" West a distance of 271.21 feet (South 360
22'00" West 272.01 feet record); thence
South 53028'47" East a distance of 311-51 feet (South 53'
38'00" East 312.00 feet record); thence
South 34045'32" East a distance of 229.84 feet (South 34*
56'00" East 230.00 feet record); thence
South 09045'29" East a distance of 232.11 feet (South 090
56'00" East 231.95 feet record); thence

distance of 31.24 feet; thence

A tract of land in Government Lot 3 of Section 6, Town-
ship 28 North, Range 21 West, m.p.m., Flathead County,
Montana, described as follows:
Commencing at the South Quarter corner of Section 31,
Township 29 North, Range 21 West, M.P.M., Flathead
County, Montana; thence
South 25"23146" West a distance of 359.94 feet (South 251
49" West 361.00 feet record) to the Point of Beginning,
which point is on the west line of that parcel described
in instruntent recorded in Book 457 page 765, records of
Flathead County, Montana; thence along the West and North
lines of said narcel

South 85044'00" West a distance of 552.05 feet to the East
line of Grandview Drive; thence along the East line of
the road

erly line of that parcel described in instrument recorded
in Book 439 page 594, records of Flathead County, Montana,
thence along the South and East lines �of said parcel the
following courses:

The approximate cost of said improvements is estimated to
be Three Hundred Thousand Dollars ($300,000.00). Said costs
will be assessed against each lot within the district for
that part of the whole cost which its area bears to the area
of the entire district. Said cost may be paid in full upon
completion of the contract, or in 20 equal annual installments
extending over a period of 20 years.
