Resolution 3241 - Finding of Blight85 page I RESOLUTION NO. 3241 A RESOLUTION FINDING THAT BLIGHTED AREAS EXIST IN THE CITY OF KALISPELL AND THAT REHABILITATION, REDEVELOPMENT, OR A COMBINATION THEREOF, OF SUCH AREAS IS NECESSARY IN THE INTEREST OF THE PUBLIC HEALTH, SAFETY, MORALS, OR WELFARE OF THE RESI- DENTS OF THE CITY OF KALISPELL. WHI__,'R�EAS, the Aieav�ide Planning Organization staff and building officials employed by the City of Kalispell, have eval- uated the social, fiscal and physical aspects of the Kalispell Central Business District and adjacent areas; and WHEREAS, this study of land uses, ownership, building conditions and demographics was conducted and reviewed by com- petent appraisers employed by the City of Kalispell on the basis of an examination of the building standards adopted by the City of Kalispell; and WHEREAS, several indicators of deteriorated conditions and blight were found in the study area; and WHEREAS, more than fifty (50) percent of the structures in the area were found to be in less than STANDARD condition; and WHEREAS, approximately eighty-six (86) percent of the streets in the study area were in less than GOOD condition; and WHEREAS, U.S. Highways 2 and 93, intersect in the area creating excessive through traffic, higher than normal traffic hazards an'd accidents, traffic congestion, and are carrying traffic loads beyond the design capacity; and WHEREAS, all'of the sewer lines in the study area are over 50 years old and many of them need to be replaced; and WHEREAS, many water lines in the study area need to be replaced; and WHEREAS, there exists over 41 non -conforming land uses in the study area; and WHEREAS, there is a net deficiency of adequate, con- venient public parking in the Central Business District; and MR Page 2 WHEREAS, demographic studies indicate there exists high concentrations of low -moderate income persons residing in the area; and WHEREAS, the studies of land use, building conditions, ownership, par -king and transportation, indicate a relationship of factors contributing to the blighting conditions which exist in the area; and WHEREAS, the studies, reports and findings,referred to herein,are available for public review at the offices of the City of Kalispell; and WHEREAS, it is the desire of the City of Kalispell to exercise the powers conferred by the Montana Urban Renewal Law; and WHEREAS, the Montana Urban Renewal Law states that no municipality may exercise any of the powers conferred therein until after its local governing body shall have adopted a Resolution of Necessity. NOW THEREFORE, DE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA: SECTION i. That one or more blighted areas exist in the City of Kalispell. SECTION 2. That the rehabilitation, redevelopment, or a combination thereof, of such area or areas is necessary in the interest of the public health, safety, morals, and welfare of the residents of the City of Kalispell. SECTION 3. That this resolution be in full force and effect from and after its passage and approval. Happ, Mayor ATTEST: c Marjoril Giermann, City Clerk Approved as to Form: City Attorney the undersigned, City Clerk of the City of Kalispell certify that the foTegoing is a trUe py of the Resolution duly passed by the City Council of the City of Kalispell, Montana at regular meeting held June 4, 1979 A A�4A-,�e e, �irk of the City of Kalispell M During January, 1979, the Arec�wide Planning Organization Staff evalu- ated the social and physical aspects of downtown Kalispell and ad- joining residential areas as they related to the definition of a "Blighted Area" contained in the State Urban Renewal Law (TITLE 11, chapter 39, R.C.M.1 Section 7-15-42, MCA) - Several indicators of deteriorated conditions were found in the study area: --More than 50 percent of the structures in the area were -found to be in less than STANDARD condition. --About 86 percent of the streets in the area were in less than GOOD condition. --The major highways, U.S. 2 and U-S. 93, are both over design capacity within the area. --None of the sewer lines in the area is less than 50 years old and a significant portion of them are in need of replacement. --A considerable portion o± the water lines are in need of re- placement, --There is a minimum of 41 non -conforming uses in the area, in light of the foregoing information, it appears to -the Staff that the study area qualifies as a blighted area.
