A RESOLUTION OF INTENTION TO ANNEX TERRITORY TO THE CITY OF KALISPELL
TO BE KNOWN AS "BERTSCHI ADDITION TO KALISPELL ADDITION NO. 75" AND
TO FIX THE DATE OF PUBLIC HEARING THEREON; To PROVIDE FOR PUBLICATION
OF NOTICE OF SAID HEARING; TO ANNEX SAID PREMISES WITH NO. 5 BUSINESS
RESIDENCE DISTRICT USE CLASSIFICATION.
WHEREAS, Loren D. Bertschi and Mary Lee Bertschi, have
made petition to the City of Kalispell for annexation to said City
of certain territory to be known as Bertschi Addition to Kalispell
Addition No. 75;and
WHEREAS, a preliminary plat thereof has been reviewed and con-
sidered in accord with the laws of the State of Montana and the sub-
division regulations of the City of Kalispell by the Kalispell City -
County Planning Board and said Board has, by communication dated

certain conditions; and it appears that said conditions are or will
be adequately satisfied, and that it is to the best interest of the
City of Kalispell that said petition be granted,
WHEREAS, in said petition said Loren D. Bertschi and Mary Lee
Bertschi have requested that said premises be given a use classifica-
tion of a No. 5 Business Residence District under the provisions of
the City of Kalispell zoning ordinance and, inasmuch as said premises
does abut a No. _I Residence District within the City of Kalispell,
therefore, as pr&��Jed by Ordinance No, 850, a public hearing on said
request must be held by the City council,
NOW THEREFORE, BE IT RESOLVED BY THB CITY COUNCIL OF THE CITY
OF KALISPELL, AS FOLLOWS:
1. It is the intention of the City of Kalispell that territory
comprising "Bertschi Addition to Kalispell Addition No. 75" shall be
annexed to the City of Kalispell and shall be classified a No. 5
Business Residence District. Said territory is more particularly
described as follows:
A tract of land in Government Lot 7, Section 6, Township
28 North, Range 21 West,.M.P.M., Flathead County, Montana,
described as follows:
Commencing at the Southwest corner of said Section 6; thence
North 89" 09' 13" East and along the boundary line common to
Section 6 and 7; a distance of 30.05 feet to a point on
the Easterly right of way of Meridian Road; said point
being the point of beginning of the tract of land to be
herein described; thence continuing along the aforesaid
boundary
North 891 09' 13" East a distance of 677.3 feet to a point on
the Westerly right of way of U.S. Highway No. 93; thence
along said right of way
North 150 51' 08" West a distance of 166.16 feet to a point,
thence
South 89' 09' 34" West a distance of 154.95 feet to a point;
thence
North 530 29' 30" West a distance of 145.86 feet to a point;
thence
North 88' 34' 49" West a distance of 347.67 feet to the South-
west corner of that certain tract of land shown on Cer-
tificate of Survey No. 2066; said point being on the

Easterly right,of way of the aforesaid Meridian Road;

South 02' 38' 4511 West a distance of 263-16 feet to the point
of beginning.
2. A public hearing on said petition for annexation will be
held by the Kalispell City Council at its regular meeting held in
the Council Chambers of the Kalispell City Hall commencing at 7:30
p.m. on the day of S&,4t. , 1977. At the same time and place a public
hearing will be held on-t-fie petition to annex said premises with
a No. 5 Business Residence District use classification applicable
thereto.
3. The Cit� Clerk will forthwith �repare and publish in the
Daily Interkake,,,a daily newspaper published at Kalispell, Montana,
proper not,-;-ce of said public hearing. Said petitioner shall pay
