Resolution 3113 - Discontinue Alley - Baker's Southside AddnRESOLUTION No. 3113 A RESOLUTION FINDING THAT IT IS NOT TO THE DETRIMENT OF THE PUBLIC INTEREST THAT AN ALLEY IN BAKER'S SOUTHSIDE ADDITION TO KALISPELL, BLOCK 1, BE DISCONTINUED AND ORDERING THAT SAME BE VACATED AND CLOSED. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA: WHEREAS, at a regular meeting of the City Council on the 117HJ day ofApr�il_1977, a petition, in writing was presented to said Council requesting the discontinuance and vacation of the following described alley within said City, to -wit: That alley in Baker's Southside Addition to Kalispell, Block 1, County of Flathead, State of Montana, according to the plat recorded with the Flathead County Clerk and Recorder, which alley bisects Block 1 from North to South, RESERVING TO the City for utility purposes a strip 10 feet wide on each side of the centerline of the alley with the right of ingress and egress for the purpose of installation, maintenance and repair of public utilities in said easement area and, further, if the City does exercise said right the City shall be liable only to refill to established grade any ditch or excavation that may be dug for such purpose and the City shall not bear any costs for the removal or replacement of any structural improvement that may be installed in such easement area by the owners thereof. WHEREAS, at said meeting, upon motion duly made, seconded and passed by said Council, the City Clerk was ordered to publish Notice that said petition would be acted upon at a meeting of said Council to be held on the 2ND day of May , 1977, as provided by Section 11-2802, R.C.M. 1947; and said Notice was duly published, as required by law, at least one week prior to the date set for acting on said petition; and WHEREAS, on this 2ND day of May , 1977, the Council having duly met and coiiv—ened and heard both proponents and opponents of said petition, NOW THEREFO the Council finds that after due consideration E of all facts d ata presented to I ally and in writing, that it e j_ is not to e de riment of the pub c in erest that said petition be g 'te e i 1 - p ra nd sai alley be d Con Inued.
