W I T N E S S E T H:
Garmen H. Meadows, James L. Scharen,
WHEREAS, James B. McKnight and Manuel V. Bauska the owners
of Lot Thirt-e-e-n--TrgT-O-r--P-o-r-t-a--V-i-ITa--N-o-.--f
of the City of
of the resubdivision of
said Premises to be known as PORTA VILLA SUBDIVISION NUMBER THREE
and all persons having an in-teres-t—in said premises have, i wr ing
consented to the resubdivision of said premises, as required bv
Section 11-3865, R.C.M., 1947, and
IMEREAS, said resubdivision does qualify for summary review and
approval under the provisions of,the Subdivision Regulations of the
City of Kalispell as now in effect, and
WHEREEAS, said Flathead County Areawide Planning Organization ba�
recomanended the City approve such resubdivision, and.
WHEREAS, the City Council, in considering this request has
found, from the preliminary plat and evidence relating thereto,
that said resubdivision is in the public interest, and in making
such finding, the Council has -considered -and weighed (a) the basis
of the need for the subdivision; (b) expressed public opinion;
Cc) effects on agriculture; (d) effects on local services,-
(e) effects on taxation; (f) effects on wildlife habitat, and (h)
effects on the public health and safety.
NOW THEREFORE, BE IT RESO LVED BY THE CITY COUNCIL OF THE CITY
OF KALISPELL, MONTANA,

SECTION 1. The Petition of James B. McKnight and Manuel V. Baus
for the resubdivision of Lot Th rteen (13) of Porta VTITa--X-o-.-7—
is hereby approved and same shall hereafter be known as
PORTA VILLA SUBDIVISION NUMBER THREE , RESUBDIVISION NO.--9-6-
of t City of Kalispell, Montana.
SECTION 2. The classification of said premises under tho
Kalispell Zoning Ordinance shall not be changed by this action.
SECTION 3. That no portion of said premises need be dedicated
to the City for park purposes, and, in accord with Section 11-3864,
R.C.M., 1947, said petitioner shall forthwith pay 'to the City of
Kalispell for_park purposes.-,T-n�ieu thereof, the sum of,$ 92.48
