A RESOLUTION FINDING THAT IT IS NOT TO THE DETRIMENT OF THE
PUBLIC INTEREST THAT A STREET IN THE CITY OF KALISPELL KNOWN
AS A PORTION OF OLD U.S. HIGHWAY NO. 93,.BE DISCONTINUED AND
ORDERING THAT SAME BE VACATED AND CLOSED.
BE ITIRESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL,
MONTANA:
WHEREAS, at a regular meeting of the City Council on
the 21 st day of March , 1977, a petition, in writing,
was j�_resentod to--iaid —council requesting the discontinuance
and vacation of the following described street within said
city, to -wit: See Exhibit "A" attached hereto and by this
reference made a part hereof.
WHEREAS, at said meeting, upon motion duly made, seconded
and passed by said Council, the City Clerk was ordered to
publish Notice that said petition would be acted upon at a
meeting of said Council to be held on the 11th day of April
1977, as provided by Section 11-2802, R.C.M., 1947; and said
Notice was duly published, as required by law, at least one
week pr ior to the date set for acting on said petition; and
WHEREAS, on this 11th day of April —, 1977, the
Council having duly met and convened and heard both proponents
and opponents of said petition,
NOW THEREFORE, the Council finds that after due considera-
tion of all facts and data presented to it orally and in writing,
that it is not to the detriment of the public interest that said
petition be granted and said street bediscontinued. The Council
further finds that said petition he granted and that said street
be discontinued and vacated. —

lying in tbe.South Half of the Southwest
6arter of Section 17, Township 2.8 North,
Range 21 14est, P.M.M., Flathead County,
Montana, extending in a southerly direction
from the Outlaw, Inc. access road on the
south side of the city Service Station
to the intersection with Third Avenue'
East, being more particularly described
as follows:
A tract of land in the S�-2SIV-. of Section 17,
Township 28 North, Range 21 West, M.p.M.,
Flathead County, Montana, described as
follows:
CoRmencing at the Southwest corner of the
said Section 17; thence
South 890 40' 35" East a distance of 1,468-42
feet to the Southeast corner of that
certain tract of land described in Deed
recorded in Book 589, page 564, records
of Flathead County, Montana; and in '
Certificate of Survey No. 2145 Revised,
records of Flathead County, Montana;
thence
North 45' 26' 52" West and along the Westerly
boundary of the County Road to a point
60 feet North of the Southerly boundary
of said Section 17; said point being the
true Point of beginning of the tract of
land to be herein described; thence
continuing
North 45* 261 52" West to a point 231-64 feet
in that direction from the southerly
boundary of said Section 17; thence
North 481 151 24" I -lest and along the said
County Road a distance of 232.06 feet
to a point on the Southerly . boundary
of that certain private road easement
as shown on Certificate of Survey No.
2145 Revised; thence
Northerly and across aforementioned County
Road, and at right angles to the center-
line thereof, to the East boundary

Southeasterly and along the Easterly boundary
of said County Road to a point of inter-
section with the Westerly boundary of
Third Avenue East of the City of Kalispell;
