A RESOLUTION TO ALTER AND AMEND THE PLANS AND SPECIFICATIONS OF CONTRACT WITH
PACK AND COMPANY, INC. ON FIRST AVENUE EAST STORM DRAIN IMPROVEMENT PROJECT.
WHEREAS, the City did, on July 22, 1976 enter into a contract with Pack
and Company, Inc. of Kalispell, Montana for construction of storm drain
improvements on First Avenue East; and
WHEREAS, upon the advice and recommendation of Thomas, Dean & Hoskins,
Inc., who is the City's consultant and engineer on said project, certain
changes and alterations in the sanitary sewer grade and pipe are necessary
because the pipe leaks and the grade is adverse. This change order will
correct these problems. Said changes and alterations have been found necessary
and adviseable and in the best interests of the City; and said changes and
alterations could not have been necessarily foreseeable when the original design
and specifications were prepared on the construction of the storm drain project.
Said changes are contained in Exhibit "All attached hereto and is by this refel-
ence made a part hereof; and

WHEREAS, it appears in the best interests of the City to approve said
changes and alterations;
NOW THEREFORE, pursuant to the provisions of Section 11-1204, R-C-M-,
1947 be it hereby resolved:
1. The alterations and modifications of the specifications and plans of
the contract between the City of Kalispell and Pack and Company, Inc,, dated
July 22, 1976v as set out in Exhibit "All attached heretop and is hereby
approved; and
2. As soon as the price to be paid for said alterations and modifications
are agreed to in writing, signed by the cPntiE4or and approved by the Council,
this approval thereof shall be in effept.' I
