A RESOLUTION TO ALTER AND AMOD THE PLANS AND SPECIFICATIONS OF CONTRACT WITH
PACK AND CWANY ON CONSTRUCTION OF STOB24 DRAIN IMPROVEMENTS, HUD GRANT NO.
B-76-I)B-30-0008.
WHAIMS? the City did, on February 9, 1977 anger into a contract with
Pack and Company of Kalispell, Montana for storm drain improvements an 7th
Avenue West on the Construction of Ste= Drain Improvements Project (11UD Grant
No- B-76-DN-30-0008); and
WIMREAS, upon the advice and recommendation of Stahly Engineering &
Associates, who is the City's consultant and engineer on said project, certain
changes and alterations of design and specifications have been found necessary
and adviseable and in the best interests of the City; and said changes and
alterations could not have been necessarily foreseeable when the original design
and specifications were prepared on this phase of the Construction of Storm
Drain Improvements Project, and said changes are contained in Exhibit "All attached
hereto and are by this reference made a part hereof; and
WEEM&S, it appears in the best interests of the City to approve said changes
and alterations,
NOW TBEREFORE, pursuant -to -the provisions of Section 11-1204, R.C.M., 1947,
be it hereby resolved:
1. The alterations and modifications of -the specifications and plans of
the contract between the City of Kalispell and Pack and Company, dated February
9, 1977, as set out in Exhibit "All attached hereto, are hereby approved; and
2. As soon as the price to be paid for said alterations andmodifications
axe agreed to in writing, signed by the contractor, as hereby approved by the
Council, this approval thereof shall be in effect.
