A RESOLUTION FINDING THAT IT IS NOT TO'THE DETRIMENT OF THE
PUBLIC INTEREST THAT AN ALLEY IN KALISPELL TOWNSITE COMPANY'S
ADDITION NU14BER 3 BE DISCONTINUED AND ORDERING THAT SAME PE
VACATED AND CLOSED.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL,
MONTANA,
WHEREAS, at a regular meeting of the city eouncil on
the 13th day of September, 1976, a petition, in writing, was
presented to said Council requesting the discontinuance and
vacation of the following described alley within said City,
to -wit:
That alley in Kalispell Townsite Company's
Addition Number 3 to the City of Kalispell,
County of Flathead, State of Montana, accord-
ing to the plat recorded with the Flathead
County Clerk & Recorder, which alley bisectp
Block 203 from North to South between Seventh
Street East and Eighth Street East, subject to
existing utility easements of record.
WhEREAS, at said meeting, upon motion duly pade, seconded
and passed by said Council, the City Clerk was ordered to
publish Notice that said petition would be acted upon at a
ineeting of said Council to be held on the 4th day,of October,
1976, as provided by §11-2802, R.C.M., 1947; and said. Notice
was duly published, as required by law, at least one week
prior to the date set for acting on said petition; and
WHEREAS, on this 4th day of October, 1976, the Council
having duly met and convened and heard both proponents and
opponents of said petition,
NOW THEREFORE, the Council finds that after due consid-
eration of all facts and data presented'to it orally and in,
writing, that it is not to the detriment of the public
interest that said petition be granted and said alley be
discontinued. The Council further finds that it is to the
best intere of the pub �io tbat-�,said petition be granted
