Resolution 3084 - Alley Discontinuance - Ted's AddnRESOLUTION NO. 3084 A RESOLUTION FINDING TTIAT IT IS NOT TO THE DETRIMENT OF THE PUBLIC INTEREST THAT AN ALLEY IN TED'S ADDITION BE DISCONTINUED AND ORDERING THAT SAME BE VACATED AND CLOSED. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, tIONTANA: WHEREAS, at a regular meeting of the City Council on the 4TH day Of Aupust 1976, a petition, in writing, was presenEed to 'Un— said Co cil requesting the discontinuance and vacation of the following described alley within said city, to -wit: The 20 foot alley in Ted's Addition to Kalispell, according to the plat thereof filed with the Flathead County Clerk and Recorder April 17, 1959, from the West edge of Grandview Drive, extending westerly and north of Lots 1, 2 and 3 of said Ted's Addition to the westerly boundary of said Ted's Addition, and thence, continuing into and across a south- easterly portion of Grandview Heights Addition No. 2, according to the plat thereof filed with the Flathead County Clerk and Recorder September 14, 1970, to the easterly edge of Mountain View Drive. WHEREAS, at said meeting, upon motion duly made, seconded and passed by said Council, the City Clerk was ordered to publish Notice that said petition would be acted upon at a meeting of said Council to be held on the 4th day of October . , 1976, as provided by Section 11-2802,_�i.C.M., 1947, and said Notice was duly published, as required by law, at least one week prior to the date set for acting on said petition; and WHEREAS, on this _j4h_ day of October , 1976, the Council having duly met and convened and heard both proponents and opponents of said petition, NOW THEREFORE, the Council finds that after due consideration of all facts and data presented to it orally and in writing, -that it is not to the detriment of the public interest that said petition be granted and said alle-� discontinued.'_­_�rhe council further finds that it is to the best crest of the pub ic that said petition be s i alle b /discogtinued and vacated. granted and th� Psvide y 9 -i)"'h e y 5 t�d above described alley be Th c discont� Zdna J vacrabtedo0c!th�prth as provided by law.
