A RESOLUTION TO ALTER AND AMEND THE PLANS AND SPECIFICATIONS OF CONTRACT WITH
PACK AND COMPANY, INC. ON SPECIAL IMPROVEMENT DISTRICT NO. 322
WfiEREAS, the City did, on February 17, 1976 enter into a contract with
Pack and Company, Inc. of Kalispell, Montana for bringing up to 6-rade, paving
and installation of curbs on a portion of Claremont Street and related work
on Special Improvement District No. 322; and
WEEREAS, upon the advice and recommendation of Stahly Engineering &
Associates, who is the City's consultant and engineer on said projbct,'certain
changes and alterations of design and specifications have been found necessary
and advisable and in the best interests of the City; and said changes and alter -
a -Lions could not have been necessaxily foreseeable when the original design and
specifications were prepared on this phase of Specia.1 Improvement District No.
322 project, and said changes are contained in Exhibit "All attached hereto and
is by this reference made a part hereof; and
WEEREAS, it appears in the beat interests of the City to approve said
changes and alterations,
NOW T11EREFOREv pursuant to the provisions of Section 11-1204, R.C.M. 1947,
be it hereby resolved:
1. The alterations and modifications of the specifications and plans of
the contract bet�reen the City of Kalispell and Pack and Company, Inc., dated
February 17, 1976, as set out in Exhibit "A: attached hereto, is hereby approved;
and
2. As soon as the price to be paid for said alterations and modifications
awe agreed to in writing, signed by the contractor and approved by the Council,
this approval thereof shall be in effect.

Curb turns and a valley gutter are necessary at the intersection of Claremont
and Crestline to help alleviate anticipated drainage problems. Items I and
2 reflect the extra quantities of excavation and curb and gutter necessary
to complete this work and compensation is being made at the unit bid prices.
A 4' wide valley gutter was included to provide better drainage from Claremont
onto Crestline. There was nounit bid price for this item. Compensation is
being made at a negotiated bid price.

Current CONTRACT PRICE adjusted by previous CHANGE ORDER $78,295.02
The CONTRACT PRICE due to this CHANGE ORDER Will be increased
