RESOLUTION NO. 3051
A RESOLUTION TO ALTER AND AMEND THE PLANS AIM SPECIFICATIONS OF CONTRACT WITH
PACK AND COMPANY, INC. ONSPECIAL IMPROVEMENT DISTRICT NO. 322
WEEMS, the City dicl, on Pebruary 17, 1976 enter into a contract with
Pack and Company, Inc. of Kalispell, Montana for bringing up to grade, paving
and installation of curbs on a portion of Claremont Street and related work
on Special Improvement District No. 322; and
WHEREAS, upon the advice and recommendation of Stably Engineering &
Associates, who is the City's consultant and engineer on said project, certain
changes and alterations of design and specifications have been found necessary
and advisable and in the best interests of the city; and said changes and alter-
ations could not have been necessarily foreseeable when the original design and
specifications were prepared on this phase of Special Improvement District No.,
322 project, and said changes are contained in Exhibit "All attached hereto and
is by this reference made a part hereof; and
WBEREAS, it appeaxe in the best interests of the City to approve said
changes and alterations,
NOW TIMWORE, pvmmant to the provisions of Section 11-1204, R.C.M., 1947,
be it hereby resolved:
1. The alterations and modifications of the specifications and plans of
the contract between.tbe City of Kalispell and,Pack and Company, Inc., dated
February 17, 1976, as set out in Exhibit "All attached hereto, is hereby approved;
and
2. As soon as the price to be paid for said alterations and modifications
are agreed to in writingi signed by the contractor and approved by the Council,
this approval thereof shall be in effect.

JUSTTFICATION-
1, The existing sanitary sewer manhole at Station 10+60 on Clarenont
Street was originally thought to fall behind the curb line. However,
the west side of the manhole falls within the curb necessitating that
the top of the manhole be raised to grade.
2. The Montana Power Company gas line under the west end of Conway Drive
was discovered during excavation to be offset from the markers. This
placed the line under the street and too high. Therefore, the line
had to be excavated and lowered.
3. The existing water main under Conway Drive was discovered to lie at
a depth much lower than normal, placing it under the new sewer stub
to the Highland Park Professional Subdivision. Therefore, the sewer

from Conway Drive per request of the Mcdical Arts Board. The Board
now has requested two approaches onto Conway from their parking area.
S. The Lutheran Home has requested a 4" water stub approximately Station
9+50 on Claremont Street to serve their proposed addition. The price
for the water service was negotiated with the Contractor.
