RESOLUTION CALLING FOR A PUBLIC HEARING
ON A PROPOSED PROJECT UNDER TITLE 11,
CIMPTER 41, REVISED CODES OF MONTANA
1947, AS AMENDED
BE.IT RESOLVED by the ___City Council

1. Reci tnIs. This City is authorized by Title 11, Chapter 41,
Revised Codes of Montana 1947, as amended (hereinafter, the Act), to acquire,
whether by construction, purchase, devise, gift or lease, or any one or more of
such methods; any land, any building or other improvement, and all real and
personal properties deemed necessary. in connection therewith, whether or not now
in existence, which shall be suitable for use for commercial, manufacturing or
industrial enterprises, recreation or tourist,facilities, and hospitals, long-
term care facilities or medical facilities. To defray the cost of acquiring and
improving any such projecL,,the City is authorized -by the Act to issue
its revenue bonds and sell such bonds at public or private sale in such manner and
at such time as may be determined by this body to be most advantageous. Such
bonds are to be secured by a pledge of the revenues to be derived by the
from the project, and may be sccurcd by a mortgage and by a pledge of the lease
and by such other security devices as may be downed advantageous. A proposal has
been presented to this Coun i. that the acting pursuant
to and in accordance with the Act, acquire properties for a project suluaWn for
use for a long-term care fac�litv
defraying the cost of acquisition thereof,
by the issuance of revenue bonds of the City in an amount presontly
estimated to be approximately $_1,200,010*Q Under the provisions of the
Act, any bonds so issued by the City shall be limiLed
of the City ; and the bonds and interest coupons shall not conntiLm.�
nor give rise to a pecuniary liability of the ___ Cjty or a charge against
its general credit or taxing powers.
2. Public HonrinR. Chapter No. 304 of the Montana Session Laws of
1974, effective on July 1, 1974, requires thpt prior to the issuance of any bon&;
under the authority of the Act, this Council — shall give notice and hold a
public hearing on the proposed project. Pursuant to such authority, a public
hearing on the proposed project is called and shall be held on
1976, at ___Y:30 o'clock n.M. at the Couivil Chamber.& City Ball
in Kalispell , Montana.
3. Yorm of Notice. The notice of the public hearing shall be in
substantially the following form:

whereupon tbe resolution was declared duly passed and adopted.

Gone Hufford, D, A, Davidson, Inc., requested cooperation of the City of Kalispell to
sell bonds for building a 55 bed addition to the present Immanual Lutheran Nursing
Rome. The amount of the bona issue will be $1,2009000.00., The project comes under
the Industrial Development Revenue Bonds program whereby the existing property plus
the addition would be vested in the name of the City of Kalispell with no financial
obligation on the part of the city. The money, bond proceedings, etc. will be handle�;
by a trustee bank. Yr. Hufford requested YAyor Rapp and councilmen to pass a res—
olution. setting a time a -ad place for a public hearing on the issue. City will be re—
imbursed for costs of the bond issue.

Councilm�m Sliter moved adoption of Resolixtion #304,16 a resolution calling for a
public hearing on a proposed project under Title 11, Chapter 41, Revised Codes of
Plantlana.1947, as amended, said project being the bond sale of $1,200,000.00 for
construction of an addition to the Immanual Lutheran Nursing Home. Seconded by Counoi--
man Williams. Roll call vote. All voted aye. Resolution adopted. ,
City Attorney Donahue to complete resolution and see that the public hearing is ad—
vertised in Daily Inter Lake.
Councilman Olson asked Mr. Hufford why an audit on our two present sewer bond obliff—
ations was necessary when the State of Montana had just completed their state audit.
Xr. Hufford replied,that bond sales are now regulated by the Security and Exchange
Commission and they have their requirements. That some past bond issues have become
