RESOLUTION NO. 3023
A RESOLUTION TO REQUIRE A PERMIT FOR ANY EXCAVATION, GRADING, FILL
OR CONSTRUCTION AND THAT ALL APPLICATIONS THEREFORE BE RFVIEWED rOR
SAFETY FROM MUDSLIDES.
WHEREAS, the City of Kalispell has adopted and is enforcing
the "Uniform Building Code" as published and adopted by the
International Conference of Building Officials, Pasadena, California;
and
WHEREAS, said code prohibits any person, firm or corporation
from erecting, constructing, enlarging, altering, repairing, im-
proving, moving or demolishing any building or structure without
first obtaining a separate building permit for each building or
structure from the City Engineer; and
WHEREAS, the City Engineer must examine all plans and speci-
fications for the proposed construction when application is made
to him for a building permit.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Kalispell as follows:
1. That the City Engineer shall require the issuance of a
permit for any excavation, grading, fill or construction in the
community; and
.2. That the City Engineer shall require review of each permit
application to determine whether the proposed site and improvements
will be reasonably safe from mudslides. If a proposed site and im-
provements are in a location that may have mudslide hazards, further
review must be made by persons qualified in geology and soils en-
gineering; and the proposed new construction, substantial improve-
ment or grading must:
(a) be adequately protected against mudslide damage; and
(b) Not aggravate the existing hazard.
