A RESOLUTION LEVYING AND ASSESSING A TAX UPON ALL PROPERTY IN
SPECIAL IMPROVEMENT DISTRICT NO, 316 TO DEFRAY THE COSTS OF
MAKING THE SPECIAL IMPROVEMENTS AUTHORIZED THEREIN.
BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
KALISPELL, AS FOLLOWS:
To defray the costs of making the special improvements
authorized in that area included within Special Improvement
District No. 316 of the City of Kalispell, as more particularly
described in Resolution No. 2918 dated August 8, 1973 and on
file in the office of the City Clerk, there is hereby levied
and assessed against all said property a tax in the total sum of
$__k5�0.00�, plus interest as hereinafter provided. Said sum
includes all costs of making said improvement and as allowed by
Section 11-2228, R.C.M., 1947, and as certified to the City Clerk
by the City Engineer upon completion and acceptance of said
improvements,
Said levy and assessment as is made hereunder against
each'lot or parcel of land within said district also shall include
accruing interest thereon at the rate of 7.7,—% until paid from
the date of registration of bonds sold and issued in accord with
Resolution No. 2998 , dated January 20, 1975, and if same
is not paid in full when so levied and assessed, said sum shall,
with interest at 7.7 _ %, be spread over a term of not to exceed
ten (10) years, p-ayments to be made in equal annual installments
as provided by Resolution No. --2969A , dated June 3 1974 -

Each lot or parcel of land within said district shall
be assessed for that part of the aforesaid whole cost which its area
bears to the area of the entire district, exclusive of streets,
avenues, alleys and public places. The description of each said
lot or parcel and the name of its owner, and the amount of each
partial payment to be made and the date when the same shall become
delinquent is set'forth on Exhibit "A" attached hereto and which,
by this reference, does becqfikd-� part hereof.

Beginning at the Southeast corner of Lot 1; thence along the
Southerly line of Lot I South 400 141 30" West 8.61 feet, North 00
381 00" East 26.21 feet and South 490 141 57" West 528.21 feet;
thence North 40* 451 03" I -lest 143.23 feet; thence North 890 120 02m

WHEREAS, the within and foregoing Resolution No. — 30314 F
signed by the Mayor and Clerk of the Council of the City of Kalispell,
Montana, was filed in the office of said Clerk of the Council on the
_17th day of November , 19 75 , and has since that date been on
file in said office, subject to ITS—Pection, and the Clerk of the Cou-
ncil naving I given notice of the passing and filing of said Resolution
by publication in the Daily inter Lake, a newspaper printed and pub-
lished in the city of Xalispell, Montana, at,l�ast five days before the
date set herein for hearing objections thereto, and the City Council
having been in session at the time and place for the hearing of objec-
tions, and no owner, or agent of any owner of lots, pieces, or -parcels
of land situated within said Special Improvement District No. - 316
or any other person, having appeared and protested against or objected
to the final passage and adoption of said Resolution or to any assess-
ment or tax hereby levied or assessed; and it appearing to the satis-
faction of the City Council that the cost of the improvements within
the said Special Improvement District No. 316 was necessary and
proper, and that the cost thereof should be assessed accordingly as
in said Resolution provided;
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
NALISP.1-AX, MONTANA:
That the"within and foregoing Resolution No. 3034 be and
the same,is hereby finally passed and adopted, and the —said assess -
meats therein provided for, and all thereof, be and the same are
hereby levied and assessed accordingly, and that tl�te first of said
assessments are now due and payable to the Citv Treasurer of the City
of Kalispell, Montana, and same will becone delinquent on January
1 , 19 76 , at 5: 00 p.m. of said day, and hereafter the '�i_nnual
