A RESOLUTION PROVIDING FOR THE CALL FOR CONSTRUCTION BIDS FOR
SPECIAL IMPROVEMENT DISTRICT NO. 322.
WHEREAS, the Mayor and City Council of the City of Kalispell,
in compliance with the statutes of the state of Montana, did, on
the 18th day of August, 1975 create Special improvement District
No. 322 of the City of Kalispell for the purpose of bringing up
to grade, paving and installing curbs on a portion of Claremont
Street, in all of that area included in, and in accordance with
the terms and conditions as specified in Resolutions No. 3019
and No. 3029.
WHEREAS, Stahly Engineering and Associates, One South Dakota
Street, Helena, Montana 59601, has submitted plans of said construc-
tion, and same have been approved by the City Engineer of the City
of Kalispell.
NOW THEREFORE, he it hereby resolved:
1. That the City Clerk forthwtih call for bids for said con-
sLruction in ac rd with the laws of the state of Montana.

form of and contain the provisions of Ex ibit "A" attached hereto.

NOTICE OF CALL FOR BIDS
CITY OF KALISPELL, MONTANA
S.I.D. 322
NOTICE IS HEREBY GIVEN that sealed proposals for bringing up
to grade, paving and installation of curbs on a portion of Clare-
ment Street, in the City of Kalispell, Montana,, will be received
by the City Council at Kalispell, Montana until 7:30 1"m., September
1975. All proposals shall be addressed to the City Clerk and
plainly marked "S.I.D. 322 Constyuction''. At a meeting of said
council at said time and place said bids will be publicly opened
and read.
The work involved is for the construction of all work for
S,T,D, 322 created August 18, 1975 by Resolution No. 3029 as specified
in plans and specification as outlined and on file at the following
addresses: Stahly Engineering and Associates, One South Dakota Street,
Helena, Montana 59601 or City Engineer, P. 0. Box 1035, Kalispell,
Montana 59901. Said resolution and and Resolution No. 3019 contain
more particular description of said district and are on file in the
City Clerk's office.
Each bidder must display his current Montana Contractor's
License, class and number.
All proposals or bids offered shall be accompanied by a check
payable to the City, certified by a responsible bank for an amount
which shall not be less than ten per centum (10%) of the aggregate
of the proposal. Said proposals or bids shall bc delivered to the
Clerk at the said City Council, and said City Council shall, in open
session, publicly open, examina, and declare the same; provided,
however, that no proposal or bids shall be considered unless accom-
panied by said check. The City Council may reject any and all pro-
posals or bids should it deem this for the public good, and also
the bid of any party who has been delinquent or unfaithful in any
former contract with the municipality, and shall reject all proposals
or bids other than the lowest regular proposal or bid of any respon-
sible bidder, and may award the contract for said work or improve-
ment to the lowest responsible bidder at the prices named in his bid.
A bond will. be required of the successful bidder in the amount
of one -hundred per cent (100%) of the aggregatc of the proposal for
the faithful performance of the contract and protection of the City
of Kalispell against the liability of accidents.
The successful contractor will be required to carry Workman's
Compensation under Plan Number Three of the Workman's Compensation
Act of Montana, and upon final settlement with the Contractor, the
City of Kalispell will deduct all unpaid premium assessments for
the Industrial Accident Fund, which the Contractor has not paid on
the labor employed by him but for not more than the amount of the
contract.
