RESOLUTION CREATING SPECIAL IMPROVEMENT DISTRICT NO. 322 FOR THE
PURPOSE OF BRINGING UP TO GRADE, PAVING AND INSTALLING CURBS ON
A PORTION OF CLAREMONT STREET, IN THE CITY OF KALSIPELL.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA:
WHEREAS, on the 16Lh day of June, 1975 said Council did
pass and adopt Resolution No. 3019, a resolution of intention
to create Special Improvement District No. 322; and
WHEREAS, the City Clerk of said City did give notice of the
passage of said Resolution by publishing same for five successive
days in the Daily In -ter Lake, a daily newspaper published in
Kalispell, Montana, beginning on July 28, 1975 and also on July 28,
1975 true copies of said Notice were mailed to all persons having
real property within said district; and
WHEREAS, on the 18th day of August, 1975, at the next regular
meeting of said Council, the Council did conduct a hearing on said
Resolution No. 3019, and insufficient protests, written or oral,
were made or presented against creating said Special Improvement
District No 322 to prevent its creation,
NOW THEREFORE, said Council does hereby create Special Improve-
ment District No. 322 for the purpose of bringing to grade, paving
and installing curbs on a portion of Claremont Street in that certain
area described in Exhibit "A" attached hereto.
The approximate cost of said improvements is estimated to be
One Hundred Ten Thousand and No/100 Dollars ($110,000.00). Said
costs will be assessed against all of the parcels of property within
said district on the basis of the proportion that the lineal feet of
said parcel abutting the streets of said district bears to the
total lineal feet of parcels abutting the street thereof within
said district and costs of intersections shall be included in the
amount of the assessment to be paid by the property of the district.
Said cost may be paid in full upon completion of the contract, or in
ten equal annual installments extending over a period of ten years.
