RESOLUTION NO. 3010
A RESOLUTION TO ACCEPT AS A SUBDIVISION WITHIN THE CITY OF KALISPELL,
MONTANA, SCHMAUCH SUBDIVISION,
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KALISPELL, MONTANA:
SECTION 1. That pursuant to the Petition of James LeRoy
Scbmauch and Lco A. Schmauch as made to the City Council Of the
City of Kalispell at its regular meeting on the 21st day of April,
1975, and upon the representation made to the Council by said
petitioners that they would submit to said Council a plat reflect-
ing the survey and designation of that territory presently withi-n
the City of Kalispell which would be so subdivided, and pursuant
to the laws of the state of Montana and the subdivision regulations
as heretofore enacted by the City of Kali -spell, the Council and
Mayor due hereby approve that the property of the petitioners
included in said plat may become, as a part of the City of Kalispell,
to be known as:
SCHMAUCH SUBDIVISION
SECTION 2. The Council has found that inasmuch as the premises
to be thus subdivided has been a portion of the City of Kalispell
for many years and as such has paid its proportionate share of the
taxes levied upon the property of the City of Kalispell for the
development of parks and playgrounds within said city, it is hereby
ordered that the requirement for land dedication for park dedication
for park purposes, or payment of cash in lieu thereof, is waived.
SECTION 3. That upon the petitioners supplying to the City
of Kalispell the proper plat suitable for recording with the Flathead
County Clerk and Recorder and such other statements and documents
that may be required by law and upon the proper recording thereof
with the Flathead County Clerk and Recorder said territory shall,
as a part of the City of Kalispell, become and be known as Schmauch
Subdivision in accord with said plat; it is further ordered that
the classification of said nrenises shall continue to be a Number
One Residence District of said city.
PASSED AND APPROVED BY THE MAYOR AND T11E CITY COUNCIL OF THE
CITY OF KALISPELL, MONTANA, THIS 21st day of April, 1975.
