RESOLUTION #3018 OF THE CITY
COUNCIL OF THE CITY OF KALISPELL, MONTANA
GRANTING EASEMENT TO FRED FRY d/b/a KALISPELL BAR
AND WAGON WHEEL LOUNGE
WHEREAS, Fred Fry, d/b/a Kalispell Bar and Wagon Wheel Lounge,
has been operating a cocktail lounge on the premises located on the
real property described in Exhibit "A" attached hereto and by this
reference made a part hereof; and
WHEREAS, the Eastern boundary of said property abuts property
of the City of Kalispell, to -wit: Main Street; and
WHEREAS, the said Fred Fry d/b/a Kalispell Bar and Wagon Wheel
Lounge desires to improve the portion of his business fronting on
Main Street and abutting said city property; and
WHEREAS, said improvement desired is to face the exterior of
said premises with stone; and
WHEREAS, said improvement and said facing would constittite an
encroachment of approximately three inches (3") onto city property;
and
WHEREAS, said facing would cause an improvement in the appearance
of said premises and would be in the public interest; and
WHEREAS, it is necessary, in order to make said improvements,
that the City of Kalispell grant to said Fred Fry d/b/a Kalispell
Bar and Wagon Wheel Lounge an easement allowing said Fred Fry to
construct and add said improvements and facing and thereby to
encroach upon the property of the City of Kalispell;
NOW, THEREFORE
"BE IT RESOLVED, that the City Council of Kalispell,
Montana, at a meeting held Monday night, the 9th day
of June, 1975, does hereby authorize the owners of
the Kalispell Barand Wagon Wheel Lounge to proceed
with the improvement ofthe portion of their premises
fronting on Main Street and abutting the property of
the City of Kalispell, by facing the front of said
premises with stone; and does hereby grant to Fred
Fry d/b/a Kalispell Bar and Wagon Wheel Lounge an
easement for such purposes over such portion of the
property of the City of Kalispell as is necessary for
such improvement."
The foregoing Resolution was unanimously passed at a meeting
of the City of Kalispell's City Council on the 9th day of June, 1975.
