RESOLUTION NO. 2929
RESOLUTION CREATING SPECIAL IMPROVEMENT DI,9TRICT NO. 315 FOR THE
PURPOSE OF INSTALLING WATER MAINS IN 4B'S ADDITION NO. 45 AND
GIBSON ADDITION NO. 41.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA:
WHEREAS, on the 8th day of August, 1973, said Council did pass
and adopt Resolution No. 2917, a resolution of intention to create
Special Improvement District No. 315; and

-, WHEREAS, the City Clerk of said City did give Notice of the
passage of said Resolution by publishing same for five successive
days in The Daily Inter Lake, a daily newspaper, published in
Kalispell, Montana, beginning on August 30, 1973, and also, on
Ai,iq,4st 30, 1973, true copies of said Notice were mailed to all
persons having real property with said district; and
WHEREAS, on the 17th day of September, 1973, at the regular
meeting of said Council the Council did conduct a hearing on said

esolution No. 2917, and a protest was made against creating said
Special Improvement District No. 315 based on the boundary thereof,
and further action to create said SID 315 was held in abeyance
pending reconsideration of the bapndary thereof; and
WHEREAS, said protest was withdrawn and further construction
of SID. 315 with the boundary as originally established has been
made by the council� said protest was withdrawn November 5, 1973,
NOW THEREFORE, said Council does hereby create Special
Improvement District No. 315 for the purpose of installing water
matins in that certain area described as follows:
4-B'S ADDITION NO. 45: A tract of land in the Southwest 1/4
of the Southeast 1/4 of Section 12, Township 28 North, Range
22 West, Principal Meridian -Montana, more particularlv
described as follows:
Commencing at the Southeast corner of the aforementioned
Southwest 1/4 of the Southeast 1/4 of Section 12; thence
North 180 471 38" West 31.55 feet to a 3/4" x 21" galvanized
iron pipe, the point of beginning; thence North 00 351 30"
East a distance of 625.73 feet to a 2" axle shaft; thence
continuing North 00 351 30" East 41.00 feet to a 3/4" x 21"
galvanized iron pipe on the Southerly boundar - v of U. S.
Highway Number 2; thence South 430 25' 5V West along the
Southerly boundary of U. S. Highway Number 2 a distance of
183.27 feet to a 3/41' x 21" galvanized iron pipe; thence
South 410 34' 02" East along the Southerly boundary of U. S.
Highway Number 2 a distance of 10 feet to a 3/4" x 21" gal-
vanized iron pipe; thence South 480 25' 58" West a distance
of 200 feet to a 3/4" x 21" galvanized iron pipe, thence
South 410 341 02" East a distance of 20 feet to a concrete
right of way monument; thence South 480 25' 53" West along
the Southerly boundary of U. S. Highway Number 2, 74.53 feet
to a 3/4" iron pipe with brass disc stamped ES2939 marking
the Northeast corner of Lot 3 of Gibson Addition No. 41 as
recorded per the Records of Flathead County, Montana; thence
South 00 371 38" West along the West boundary of the afore-
mentioned Lot 3 a distance of 344.69 feet to a 3/411 iron
pipe with brass disc stamped ES2989 on the North boundary
of Appleway Drive; thence North 890 161 09" East along the
North boundary of Appleway Drive a distance of 319.5 feet
to the point of beginning.
