,LSOLUTION NO. 2912
A RESOLUTION TO INCORPORATE INTO THE CITY OF KALISPELL, AS AN
ADDITION, WEISSMANS ADDITION, KALISPELL ADDITION NO. 48.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL,
MONTANA:
SECTION 1. That pursuant to the petition of Carl Weissman and
Sons, Inc., a Montana corporation, filed with the City Council
of the City of Kalispell, on the ?7rh day of Fvro�or _ , 1973,
and the submission to said CounciT-b—ysaid Peti—tioner of a plat
reflecting the survey and designation of that territory adjoin-
ing and adjacent to the City of Kalispell, into streets and blocks
as an addition thereto, and pursuant to Section No. 11-401, Revised
Codes of Montana, 1947, as amended, the Council and Mayor do
hereby approve that said territory may become a part of the City
of Kalispell, to be known as:
WEISSMANS ADDITION, KALISPELL ADDITION NO. 48.
SECTION 2. That the City Council has found good cause for the
waiver of 1/9 of the total area of said Addition to be set aside
in,said Addition for park purposes; and, the Council further finds
it to be to the best interest of the City to accept a cash
donation of the value of 1/9 of the total area of said Addition
in lieu of land for park purposes therein and the City does
hereby order that said amount shall be the sum of $558.66, which
sum shall be deposited in the park fund of the City to be used
according to law.
SECTION 3. That upon the proper filing of said plat in the office
of the County Clerk and Recorder of Flathead County, Montana, said
territory shall become a part of the City of Kalispell, and shall be
classified as a No. 5, Business -Residence Distr , tet of said city,
PASSED AND APPROVED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY
OF KALISPELL, MONTANA, THIS 27th DAY OF November 1973.

EASEMENT
KNOW ALL MEN BY THESE PRESENTS:
The undersigned, Carl Weissman and Sons, Inc., a Montana Corp.,
for itself, its assigns and successors in interest forever, does
hereby give and grant unto the City of Kalispell, a municipal corpora-
tion of the State of Montana, an easement for sidewalk and/or street
and sewer and water line purposes over, under, through and across:
The Westerly Ten (10) feet of Weissmans Addition,
Kalispell Addition 48 to the City of Kalispell,
Flathead County, Montana.
This easement is granted to the City of Kalispell for sidewalk,
S't'keet and utility line purposes only as such may be needed as Dart
of a development of sidewalk installation and street improvement and
utility line installation use along the street known as meridian Road
directly west of the said property.
