Resolution 2916 - Authorize Application for Funds - Woodland ParkE RESOLUTION NO. 2916 � RESOLUTION AUTHORIZING THE CITY OF KALISPELL TO MAKE APPLICATION '0 THE STATE FISH AND G)VU,' CO'41ISSIO14 FOR FINANCIAL ASSISTANCE FOR 2HE KALISPELL - WOODLAND PARK (IAPROVE!iENTS) PROJECT I?I THE ESTIAATED MIOUIT OP �80,000.00; THAT SAID FUNDS WILL BE ACCEPTED ON THE TEVIS AND CONDITIONS OF THE BUREAU OF OUTDOOR RFCREATIONI THAT THE CITY WILL FOLLOW THE PLANS AND SPECIFICATIONS APPROVED THE BUREAU OF PUTDOOR RECREATION; THAT THE CITY WILL FINANCE ITS SHARE Of THE COST OF THE PROJECT AND SAME WILL BE OPERATED AND MAINTAINED FOR THE USE OF THE PUBLIC; THAT THE CITY HAS RECEIVED NO FINANCIAL ASSISTAACE FROM ANY OTHER FEDERAL PROGR;V11 THAT THE CITY WILL COMPLY WITH THE TERMS AND INTENT OF TITLE VI OF THE CIVIL RIGHTS ACT OF 1964; THAT THE CITY WILL MAINTAIN ADEQUATE FINANCIAL RECORDS OF THE P�PJECT; AND AUTHORIZING THE 14AYOR TO EXECUTE ANY DOCUMENTS TO CARRY OUT �THE PROJECT. BE IT RESOLVED BY THE CITY OF KALISPELL THATt "W,HEREAS# The City of Kalispell is interested in acquiring land$ or developing outdoor recreational facilities on the following des- cribed project for the enjoyment of the citizenry of Kalispell and the State of Montana: Project Title - Kalispell -Woodland Park (Improvements) Total Estimated Cost - $80,000.00 Brief Description of Projects This project will center around the restoration of a lagoon that is the main focus of Woodland Park. The project work will consist of: a water well with pump, draining the lagoont removal of siltation and debris from the bottom of the lagoon, back -filling lagoon bottom with gravel, construction of foot bridges, landscaping, construction of tennis courts and general site preparation. AND# Land and Water Conservation Fund financial assistance is required for the acquisition ordevelopment of said outdoor recreational facilities, NOW THEREFORE, be it resolved by the City of Kalispell that the project described above be authorized, AND, be it further resolved that said City of Kalispell make application to the State Fish and Game Commission to seek Land and Water Conservation Fund financial assistance from the Bureau of Outdoor Recreation in the amount of 50% of the actual cost of the project in behalf of said City of Kalispell. AND, be it further resolved by the City of Kalispell that it certifies to the followingi 1. That it will accept the terms and conditions set forth in the BOR Grants -in -Aid Manual and which will be a part of the Project kgreement for any grant awarded under the attached proposal. 2. That it is in complete accord with the attached proposal and that it will carry out the acquisition and/or development in the manner described in the proposal and any plans and specifications attached thereto unless prior approval for any change has been -received from the Commission* 3. That it has the ability and intention to finance its share of the cost ' of the project and that the project will be operated and maintained at the expense of said City of Kalispell for public out- door recreation use. 4. That no financial assistance has been given or promised under any other Federal program or activity with regard to the proposed project. 5. That it will not discriminate against any person on the basis of race, color or national origin in the use of any property or facility acquired or developed oursuant to this proposal, and shall comply with the terms and intent of Title VI of the Civil Rights Act of 1964, P.L. 88-352 (1964) and of the regulations promulgated pursuant to such Act by the Secretary of the Interior and contained in 43 CPR 17. 6. That it will maintain adequate financial records on the proposed project to substantiate claims for cost sharing. 7. The Mayor is hereby authorized and directed to execute any documents necessary to apply for the aforementioned funds, enter into agreement with the State of Montana, Department of Fish and Game, in relation thereto and/or to comply with any State or Federal regulation concerning said project.
