WHEREAS, the City of Kalispell, on the 21st day of Mmombor 1972, entered into an agreement with the Sta-tT`67-Montana, and t1le Board of Health and Fnvironmental Sciences of said State, whereby said State and Board agreed to grant to the City the sum of $238,000.00 as matching money in the amount of 25% of the total estimated cost of the planned selvaqe treatment plant expansion and improvement to a secondary sewage treatment plant, in accord with Section 69-4808.1, R.C.M., 1947, House Bill No. 476 of the 42nd Session of the Montana Legislative Assembly and '-Regulation No. 53.102 of said Board; and T-7HERFAS, new Federal legislation since said agreement provides for an increase to 75% the amount the U. S. Government will participate in the costs of such projects; and WHEREAS, the City appears to be eligible to ap ' T ; )lv for and receive an increase in Federal assistance in financing said sewage imnroverient and expansion project from 50% to 75% thereof; and �,7HEREAS, said State and Board have requested the City to renegotiate said agreement and the City has been assured that the Citv will not receive matching funds for said project of less than 80% of the cost thereof as originally provided for in agreements between the City and the U. S. Government and the City and the State and said Board; NOW THEREFORE, BE IT RESOLVED- 1. The Mayor is hereby authorized to apply for crrants of additional Federal matching funds for the planned sewage plant, improvements and expansion of the City. 2. The Mayor is hereby authorized to renegotiate with said State and Board the provisions of the Agreement entered into by the City with said State and Board on the 2let day of Pecmber 1.972, and to release said State and Board T-ron said AqreemenE and to execute, on behalf of the City, a new agreement with said State and Board providing that the City shall receive from the State of Montana, matching funds for said project in the amount of 5% of the total,cost thereof or $ 47,600.00 , whichever is the lesser. 3.
