Resolution 2807 - Vacate a Portion of 11th Ave WRESOLUTION NO. 2807
A RESOLUTION FINDING THAT IT IS NOT TO THE DETRIMENT OF THE PUBLIC
INTEREST THAT A PART OF ELEVENTH AVENUE- WEST, IN THE CITY OF KALISPELL,
BE DISCONTINUED AND ORDERING THAT SAME BE VACATED AND CLOSED.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA%
WHEREAS, at a regular meeting of said Council on the 6th day of
June, 1971, a petition, in writing, was presented to said Council by
Ethel M. Croskrey, requesting the discontinuance and vacation of the
following described street within said city, to -wit:
All that part of Eleventh Avenue West in Kalispell, Montana
lying northerly of the northerly boundary of Seventh Street
West in Kalispell, Montana, according to the official plat
thereof on file with the Clerk and Recorder of Flathead
County, Montana.
WHEREAS, at said meeting# upon motion duly made seconded and
passed by said Council, the City Clerk was ordered to publish
Notice that said petition would be heard and acted upon, as provided
by Section 11-2802, R.C.M., 1947# at a meeting of said Council to be
held on the 6th day of July, 19711 and
WHEREAS, said Notice was duly published, as required by law,
at least one week prior to the date set for acting on said petition; and
WHEREAS, on the 6th day of July, 1971, the Council having duly
met and convened and heard the proponents of said petition# and there
being presented no protests to said petition,
NaW THEREFORE, the CounCill
1. Finds, after due consideration of all facts and data
presented to it orally and in writing, that it is not to the detriment
of the public interest that said petition be granted and said street
be discontinued;
2. And the Council hereby orders the above described street be
discontinued and vacated forthwith as provided by law. ,
