WHEREAS, the City of Kalispell has an easement For a ditch and pipe
conduit over, across and through the southerly pnrtion of the Great Northern
Railway Company railroad right of way located in tt,,L Southwest Quarter of
the Southwest Quarter of Section 7. and the Northwest Quarter of the North-
west Quarter of Section IB, all in Township 28 North, R,nge 21 West, and the
Northeast Quarter of the Northeast Quarter of Section 13, Township 29 North,
Range 22 West, and
WHEREAS, the waters of a certain non -navigable stream known as Bowser
Spring Creek flow through the aforementioned ditch and pipe conduit, and

WHEREAS, E. D. McCarthry, Inc., a Washington Corporation, Intends to
divert and change the manner and direction and flow of said Bowser Spring
Creek so that the waters of said stream will no longer flow through the afore-
mentioned ditch and pipe conduit, and
14HEREAS, the layer and City Clerk of the City of Kalispell have hereto-
fore granted a Release of all of the right, title and interest of the City
of Kalispell, in and to the waters of Bowser Spring Creek as it now flows through
said ditch and pipe conduit, to E. D. M,.cCartby, Inc.
OOW THEREFORZ, BE IT RESOLVED by the Council of the City of Kalispell,
that the actions of the Mayor and City Clerk of the City of Kalispell grant-
ing to E. D. YcCarthy, Inc., a Release of all of the right, title and interest
of the City of Kalispell, in and tQ the waters of Bowser Spring Creek as it
now flows, are hereby ratified and approved.
