A REGULAR MEETING OF THE KALISPELL CITY COUNCIL WAS HELD AT 7:00 P.M., AUGUST 17, 2015, IN THE COUNCIL CHAMBERS AT CITY HALL IN KALISPELL, MONTANA. MAYOR MARK JOHNSON PRESIDED. COUNCILORS ATKINSON, CARLSON, GABRIEL, GRAHAM, GUIFFRIDA, KLUESNER, KUNTZ, AND SAVERUD WERE PRESENT. Also present: City Manager Doug Russell, City Attorney Charles Harball, Deputy City Clerk Judi Funk, Finance Director Rick Wills, Senior Planner Jarod Nygren, and Chief of Police Roger Nasset. .,20117-kWilli Guiffrida moved to approve the Agenda. The motion was seconded by Gabriel. The motion carried unanimously upon vote. 1. Council Minutes - Regular Meeting - August 3, 2015 08-03-15 Council Minutes Draft Atkinson moved to approve the Consent Agenda. The motion was seconded by Guiffrida. The motion carried unanimously upon vote. C. COMMITTEE REPORT - None Gil Jordan, Coram, presented information on the Central School Museum, stating it is a collective attraction with the other museums in town and contributes to the success of the entire valley. Kalispell City Council Minutes August 17, 2015 Page 1 Turner Askew, Whitefish, stated the Flathead County 911 Foundation would like to implement a Smart 911 system and they are planning to hold fundraisers in order to fund the program and educate citizens on its use. Mayre Flowers, Citizens for a Better Flathead, relayed that the Super 1 recycling center has moved to the 4th Street side of Kalispell Medical Equipment. She said there are three standard recycling bins and it is very important to sort and separate items correctly. Pam Carbonari, Kalispell Downtown Association and Business Improvement District, reminded council they would like to schedule a work session regarding the Downtown Business District and spoke about upcoming events, including the remaining Thursday!Fests, Taste of Kalispell, and a Block Party fundraiser for the Climbing Wall. Council accepted comments concerning a proposal to amend the budget to accommodate the purchase of property at Old School Station. Mayor Johnson opened the public hearing. Seeing no one who wished to speak, Mayor Johnson closed the public hearing. This resolution amends the budget to accommodate the purchase of property at Old School Station. Res. 5725 Old School Station Budget Amendment Public Comment None. Atkinson moved to approve Resolution 5725, a resolution to amend the annual appropriations of the City of Kalispell, Montana, as set forth in the 2014-2015 budget adopted by the city council. The motion was seconded by Kuntz. The motion carried unanimously upon roll call vote. 2. Resolution 5726 - Preliminary Plat Extension - Willow Creek This resolution approves a two-year extension to the Preliminary Plat of Willow Creek Subdivision. Mayor Johnson wondered whether language should be inserted stating this is a final extension so the developer is aware of the fact; Harball replied that the city follows this councils' rules and a future council may change those rules. Saverud moved to approve Resolution 5726, a resolution approving a two-year extension to the preliminary plat of Willow Creek Subdivision. The motion was seconded by Gabriel. The motion carried unanimously upon roll call vote. 3. Alcohol Special Event Permit - Taste of Kalispell This motion seeks approval of the Kalispell Downtown Association request for a permit to serve alcohol as part of its Taste of Kalispell celebration on September 3, 2015. Taste of Kalispell Special Event Permit Public Comment Pam Carbonari, Kalispell Downtown Association and Business Improvement District, asked for councils' support for this permit, stating this is the sixth annual Taste of Kalispell and this year it has been moved to the Thursday before the Labor Day weekend. Guiffrida moved to approve the Kalispell Downtown Association's request for a permit to serve alcohol as part of its Taste of Kalispell celebration on September 3, 2015. The motion was seconded by Kluesner. Guiffrida spoke in support of the event. The motion carried unanimously upon vote. 4. Resolution 5727 - Budget Resolution - Mall Levy This resolution sets the annual mill levy for the City of Kalispell for fiscal year 2016. Res 5727 Budget Mill Levv Public Comment None. Gabriel moved to approve Resolution 5727, making the annual tax levies for the City of Kalispell, Montana, for the fiscal year 2015-2016. The motion was seconded by Atkinson. The motion carried unanimously upon roll call vote. This resolution sets the annual appropriations for the City of Kalispell for fiscal year 2016. Res 5728 Annual Appropriations Public Comment None. Atkinson moved to approve Resolution 5728, a resolution setting the annual appropriations for the City of Kalispell, Montana, for special revenue funds, debt service funds, capital project funds and proprietary enterprise funds as set forth in the 2015-2016 budget adopted by the city council. The motion was seconded by Kuntz. Guiffrida commented that, although staff did a good job, he will not vote in favor of Resolution 5728 because he still has issues with the 911 Center and ambulance funding mechanisms. The motion carried upon roil call vote with Atkinson, Carlson, Gabriel, Graham, Kluesner, Kuntz, and Saverud voting in favor, and Guiffrida and Mayor Johnson voting against. This resolution levies the assessment for the cost of urban forestry maintenance for fiscal year 2016. Res 5729, Urban Forestry Budget Staff answered questions. Public Comment Pam Carbonari, Kalispell Downtown Association and Business Improvement District, commented that not having an urban forester on staff is hurting the city and the dead trees need to be removed more quickly. She remarked she is concerned that there is not enough money in the budget for trees and requested the council increase next years' budget for urban forestry. Kalispell City Council Minutes August 17, 2015 Page 4 Kuntz moved to approve Resolution 5729, a resolution levying an assessment for the cost of urban forestry maintenance in the city for the fiscal year 2015-2016. The motion was seconded by Carlson. There was discussion. The motion carried unanimously upon roll call vote. 7. Resolution 5730 - Budyet Resolution - Solid Waste This resolution levies the assessment for removing solid waste from city streets and alleys for fiscal year 2016. Res 5730 Solid Waste Budget Public Comment None. Kluesner moved to approve Resolution 5730, a resolution to levy the cost of removal of garbage or other offensive matter from streets, alleys or on any premises as a special tax against property from which such matter was deposited, and the disposition thereof. The motion was seconded by Guiffrida. The motion carried unanimously upon roll call vote. 8. Resolution 5731 - Budget Resolution - Street Maintenance This resolution levies the assessment for maintaining the streets and avenues for fiscal year 2016. Res 5731. Street Maintenance Budget Resolution Public Comment None. Kluesner moved to approve Resolution 5731, a resolution levying an assessment for the cost of special maintenance for the purpose of maintaining the streets and avenues of the City of Kalispell for the fiscal year 2015-2016. The motion was seconded by Carlson. The motion carried unanimously upon roll call vote. 9. Resolution 5732 - Budget Resolution - Storm Sewer Maintenance This resolution levies the assessment for maintaining the storm sewer utility for fiscal year 2016. Graham moved to approve Resolution 5732, a resolution levying assessments for the cost of storm sewer maintenance for the fiscal year 2015-2016. The motion was seconded by Kuntz. The motion carried unanimously upon roll call vote. This resolution levies the assessment for maintaining the street lighting in the city for fiscal year 2016. Res 5733, Light Maintenance District Budget Public Comment None. Kluesner moved to approve Resolution 5733, a resolution levying an assessment for the cost of lighting the streets and alleys in the city special lighting district for the fiscal year 2015- 2016. The motion was seconded by Graham. There was discussion. The motion carried unanimously upon roll call vote. This resolution approves the annual appropriations and annual tax levy for the Kalispell Downtown Business Improvement District for fiscal year 2016. Res 5734, BID Budget Public Comment Pam Carbonari, Kalispell Downtown Association and Business Improvement District, asked for councils' support for the BID budget and stated she looks forward to their continued partnership. Saverud moved to approve Resolution 5734, a resolution making the annual tax levy for the BID (Business Improvement District) of Kalispell, Montana, for the fiscal year 2015-2016 Kalispell City Council Minutes August 17, 2015 Page 6 and levying an assessment for the BID for fiscal 2015-2016. The motion was seconded by Guiffrida. The motion carried unanimously upon roll call vote. This resolution approves the annual appropriations for the Tourism Business Improvement District for fiscal year 2016. Res 5735 TBID Budget Public Comment None. Gabriel moved to approve Resolution 5735, setting the annual appropriation for the Tourism Business Improvement District of the City of Kalispell, Montana, as set forth in the 2015-2016 budget adopted by the city council. The motion was seconded by Carlson. Kluesner remarked that we need to work with our legislators in order to tap more tourist dollars. The motion carried unanimously upon roll call vote. 13. Resolution 5736 - Budget Resolution - City/County health Department This resolution approves the levy request for the City/County Health Department for the 2015/2016 fiscal year. Res 5736 City -County Health Public Comment None. Gabriel moved to approve Resolution 5736, making the annual tax levies for the City of Kalispell, Montana, for the fiscal year 2015-2016. The motion was seconded by Kuntz. The motion carried unanimously upon roll call vote. G. MAYOR/ COUNCIL/ CITY MANAGER'S REPORTS (No Action) Russell informed council the next work session will be a continuation of an employee evaluation, and September's work sessions will include impact fees and the Kalispell Downtown Association's request. Kalispell City Council Minutes August 17, 2015 Page 7 Russell also spoke regarding the TIGER grant and the letter from Northwest Drywall regarding the Rail Park.
