Resolution 2435 - Vacates Portion of AlleyUZTU�* �
WHERZASq The City Council of the City of Kalispell, Montana, having received a
petition for the vacation and abandonment of the Northerly 134 feet of alley In
Block 256 of Addition No. 3. and further finding that said petitioil alleges that
all the owners of lots adjoining said section of alley to be abandoned have signed
said petition, and that said petition was In writing, and that the vacation and
abandonment of said alley can be done without detriment to the public interest,
and further finding that notice of said petition was duly givenin accordance with
Section 11-2802 of the Revised Codes of the State of Montana, of 1947.
NOW THEREFORE BE IT RESOLVeDt by the Mayor and City Council of the City of Kalispell,
Montana, that it is ordered and decreed that the above named and described section
of alley be, and the same is hereby vacated, abandoned and discontinued, and that
the'land therein shall att*ch to and become a part of the adjoining lots and properties.
The City retains an easement along said alley for sewer and water line maintenance.
