Resolution 2386 - Resolution of Intent - SID 297VSOUff ION OF INTENTION TO CREATE SPECIAL IMPR0VE?4&NT:1 DISTRICT No. 297o BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA: SECTIOW1. That it is the Intention of the City of Kalispell, Montana, to create Special, TmprovAMeftt.,D19trict Noo,­297'for the purpose of Installing new�wAt6r,"inscon- slating of.approximately 2545,1eet of eight,inch-mains together with the necessary hydrants and appurtenances in'Underbill Subdivision and Adam Addition to Kalispell, Montana. SECTION 2. That the b6undarlas�'of�,the.area to be indluded within this Special.Improve- mAnt District are described.as follows: , I I Beginning at the Southwest corner of Lot 1, Section 7, Township 28 North, Range 21 West, said point being 1313.6 feet Southerly from the Northwest corner of Section thence No 89 521 450 E., a distance of 30.82 feet to a point on the Easterly Boundary of Meridian Road; thence N. 0 329 W., 60 feet to the true point of beginning; thence No 49 521 45" E,, 695.2 feet* thence S. 0 330 E. 60 feet to a point on the Southerly boundary of said Lot 1; thence N. 89 520 4511 E., 381.12 feet to the established Southeast corner of said Lot 1; thence N. 0 040 E., 300 feet; thence So 89 520 45" W., 384.3 feet; thence No 0 331 W., 63 feet; thence So 89 W 4511 W., 695.07 feet to a point on the Easterly boundary of Meridian Road; thence S. 0 320 W.r 303 feet to the point of beginning. All of Blocks 5,6, and 7; lots 2,3,4,5,6,7, and 8 of Block 1; lots 13,14, and 15 of Block 2; lots 4,5,6,7. and 8 of block 3; the South 326 feet of Hawthorn Park, being an area 326 feet by 125 feet, All of the above lots and blocks and park area being contained within the boundaries of Adam Addition which are described as follow; All that singular that certain tract or parcel of land situate, lying and being in themek NFk oil Section 12, Township 28 North, Range 22 West of the M. P. M. and being more particularly described as follows; beginning at the Northeast corner of the aforesaid Section 12; thence So 0 431 go, 1066.78 feet along the Easterly line of aforesaid Section 12, to a point, which point to N. 0 430 W. 255 feet from the Southeast corner of aforesaid Na Ngk; thence So 89 45$ W. 29.12 feet to the West- erly right of way of Meridian Roadt as constructedv to a point which is the true point of beginning of this subdivision, thence So 89 45e W. 1244,60 feet to a point; thtabe N. 0 Oil E. 1030.35 feet to a point on the Southerly right of way of Three Mile Drivet thence N. 89 320 E. 833.83 feet to a point; thence along a 15 064 curve to the right of a 379.3 foot radius for a length of 594.26 feet to the point of termination; thence So 0 42t E. 657.43 feet. along the Westerly right of way of Meridian Road, to the point of beginning. SECTION 3. That the general character of the improvements to be made in said prpposed Special Improvement District, to the installation of water main$ and the necessary appurtenanceso SECTION 4. That the estimated cost of such improvements to $21,000.00. SECTION 5. That the entire cast and expense of such Improvements shall be assessed against each lot within the district to be assessed for that part of the whole cost which Its area bears to the area of the entire district. SECTION 6. That said assessment shall be paid for In full upon completion of the contract, or shall be paid In ton annual installments hereby extended over a period of tan years. Said assessments shall constitute a fund to be known as Special Improve- ment District fund No. 297. SECTION 7. That said improvements shall be paid for in Special improvement District Warrants issued against said District in sums not to execed $1,000.00 each, bearing Interest at a rate not to exceed 6% per annum, from the date of registration until called for redemption or paid in full. SECTIO14 So That on the 6th day of July, 1959, in the Council Chambers of the City Hall in the City of Kalispell, Montana, at 7:30 P. M., at a regular meeting, the City Council will hear and pass on any protests that may be made Against the making of said improvements or the creation of said District. SECTION 9. The City Clerk An hereby authorized and Instructed to give the proper notice of the passage of this resolution by publication and mailing as required by law. Such publication Is to be made In the Daily Inter Laket a daily newspaper, published in tbe,eity-of Kalispell, Montana.
