Resolution 2348 - Street Abandonment - Portion of Summit AveRESOLUTION NO. 2343
BE IT HEREBY RESOLVED THAT WE, THE MAYOR ANT) CITY COUNCIL of the City
of Kalispell, Montana, after receiving a petition for the discontinuance
and abandonment of a portion of the street designated "Suninit Avenue"
in Highland Park Addition to Kalispell, more particularly described as
follows:
All that portion of Su=it Avenue located westerly from the
Southerly extension of the Westerly boundary of Claremont
Street to the Northerly extension of the Westerly boundary
line of Lot 14, Block 2, as sho-,m on the official plaL of
Highland Park Addition, located in Section 7, Township 28
North, Range 21 West, Flathead County, Montana.
and further finding that said petition alleges that all of the ow-aers
of lots adjoining said Street to be abandoned have signed said Petition,
and that said petition was in writing, and that the discontinuance and
abandonment of said street can be done without detriment to public interest,
and further finding that notice of said petition was duly given in
accordance with Section 11-2802 of the Revised Codes of Montana, 1947.
NOW THEREFORE BE IT RESOLVED THAT WE, THE MAYOR AND CITY COUNCIL
of the City of Kalispell, Montana, hereby order and decree that the
above described street be, and the same is hereby vacated, abandoned
and discontinued, and that land therein shall attach to and become
part of the adjoining lots and properties.
