Resolution 2336 - Resolution of Intent - SID 2940 3 RESOLUTION NO. 2336 RESOLUTION OF INTENTION TO CREATE SPECIAL IMPROVEMENT DISTRICT NO. 294. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA: SECTION 1. That it is the intention of the City Council of the City of Kalispell, Montana, to create Special Improvement District No. 294 for the purpose of participating with the State Highway Commission and the Bureau of Public Roads for the widening and rebuilding of Idaho Street within the City Limits of Kalispell, and the rebuilding of North Main Street and Sunset Boulevard along the present right of way of U. S. Highway 93 from Idaho Street to Wyoming Street, according to the plans and specifications of Projects No. F 270 (7) and U 257 (14) of the Montana Highway Commission, to wht h reference is hereby made. SECTION 2. That the area to be included within said Special Improvement District shall be as follows: All lots, blocks and unplatted areas exclusive of streets and alleys lying north of the North boundary of the Great Northern Railway Company right of way and within that portion of the City of Kalispell bounded as follows: Commencing at the intersection of the Westerly right of way of the Great Northern Railway Company right of way with the Northerly subdivision line of the Southwest Quarter of Section 8, Township 28 North, Range 21 West of the Montana Principal Meridian; thence Westerly along the Northerly subdivision line of the said South- west Quarter to Its intersection with the center line of Eighth Avenue East North, produced; thence, in a Northerly direction along the center line of Eigbth Avenue East North, to its intersection with the Northerly boundary of East California Street; thence No. 760 111 E. along the Northerly boundary of East California Street, a distance of 48.87 feet, more or less, to the intersection of the Northerly Boundary of East California Street with the Easterly boundary of the Southwest Quarter of the Northwest Quarter of said Section 81 thence N. 50 110 W., 175.9 feet to a point; thence S. 730 W W., 328 feet to a point; thence South 165.8 feet to an intersection with the Northerly boundary of East California Street; thence in a Westerly direction along the Northerly boundary of East California Street a distance of 1066.5 feet, more or less, to a point; thence N, 14 350 W., 225 feet; thence N. 560 15# W.2 365 feet; thence S. 210 551 W., 405 feet; thence S. 140 350 E., a distance of 59 feet to the North line of Woodland Avenue Northt an abandoned avenue; thence N. 840 041 W., 171.5 feet; thence N. 400 371 W., 608.6 feet, more or less, to the Northerly boundary of Wyoming Street; thence No. 430 251 W., 192.5 feet, more or less, to an Intersection with the Southerly boundary of the Northeast Quarter of the Northeast Quarter of Section 7, Township 28 North, Range 21 West of the Montana Principal Meridian; thence Westerly along the Southerly boundary of said Northeast quarter of the Northeast Quarter a distance of 138.2 feet to the Southwest Corner of the Northeast "'uarter of the NORTHeast quarter of said Section 7; thence N. 00 55t E. along the Westerly boundary of said Northeast �":Uarter of the Northeast Quarter, a distance of 98.42 feet; thence N. 760 111 E., 110 feet; thence No. 530 492 W., 43.08 feet; thence No. 360 L6, w., 121.8 feet, to a point on the regular subdivision line; thence S. 00 55* W., 48.32 feet; thence N. 330 531 W., 458.2 feet; thence No. 430 301 W., 303.0 feet; thence West 96.13 feet; thence N. 680 49* W.j 48.9 feet; thence S. 760 111 W., 179.4 feet to a point on the West line of Main Street of the City of Kalispell; thence S. 130 492 E. along the Westerly boundary of Main Street to an intersection with the Northerly boundary of the Southwest Quarter of the Northeast Quarter of said Section 7; thence Westerly along the Northerly boundary of the Southwest Quarter of the North- east Quarter of the Northerly boundary of the Southeast Quarter of the Northwest Quarter of the said Section 7 to an intersection with the Easterly boundary of U. S. Highway No. 2; thence Easterly along the said Northerly boundary of U. S. Highway No. 2, a distance of 1064.35 feet; more or less, to the easterly boundary of said Govern- ment Lot three; thence southerly along the Easterly boundary of Government Lots Three and Four of said Section 7 to the intersection of the Easterly boundary of Government Lot Four with the Northerly boundary of the Great Northern Railway Company right of way; thence Easterly along said Northerly right of way of the Great Northern Railway Company right of way to the point of beginning; and that the City Council of the City of Kalispell, Montana, hereby finds and determines that the contemplated work or improvement is of more than local or ordinary public benefit, and that the real property included in such district will be specially benefitted and affected by avlah improvement, and the property included within' the boundaries of said district is hereby declared to be the property to be assessed to pay for the cost and expense of making said Improvement as hereinafter set forth. SECTION 3. That the general character of the improvements to be made in the proposed Special Improvement District is the widening of Idaho Street to seventy- four feet and the construction of a four lane highway, with replacement of exist- ing curbs and sidewalks, on Idaho Street and on North Main Street anti Sunset Boulevard along the present right of way of U. S. Highway 93 from Idaho Street to Wyoming Street, Including the purchase of necessary right of way and the construction of catch basins to provide for drainage and other structures and work connected with said projects, all according to plans and specifications of the State Highway Commission and Bureau of Public Roads, Projects No. F 270 (7) and U 257 (14) on file in the office of the State Highway Commission, to which reference is hereby made and which may be referred to for more particulars. SECTION 4, That the estimated total cost of the entire program above mentioned, of which such Special Improvement District is a part, is $440,000.00, and the estimated share to be borne by such Special Improvement District is $110,000.00, or twenty-five per cent of the total cost of such project, whichever is the lepoer. SECTION 5. That the share to be paid by said Special Improvem4nt District in the estimated amount of $110,000.00 shall be assessed'against all the property within the area described above on an area basis in proportion that the area of each lot or tract bears to the total area in the district, except that each square foot of land within the district lying within 25 feet of the boundary line of the streets on which such improvements are to be made as designated by the specifications of 505 the State Highway Commission shall bear double the amount of cost of such improve- ments per square foot of such land that each square foot of any other land within the District shall bear, such boundary line of the streets being the boundary line after the improvements are made* as per the plans and specifications referred to above. SECTION 6. That said assessment shall be paid for in ten equal annual installments hereby extended over a period of ten years. Said Assessment shall constitute a fund to be known as Special improvement District Fund No. 294. SECTION 7. That sakI share of the cost of improvements shall be paid out of funds realized from the sale of Special Improvement District bonds issued against said District in amounts not to exceed $5mQOO.00, bearing interest not to exceed 6% per anuum from the date of registration until called for redemption of paid in full. SECTION 8. That the City Clerk is hereby authorized and directed to give the proper notice of the passage of this resolution by publication and mailing, as required by law, such publication to be made in the Daily Inter Lake, a daily newspaper published in the City of Kalispell, Montana. That such notice shall designate the next regular meeting of the City Cotincil to be held following the publication and mailing of proper notices as the time and place when and where any protests against the creation of the district or the improvement proposed to be made will be considered.
