Resolution 2332 - Resolution of Intent - SID 293mm RESOLUTION NO. 2332 RES(TUTI(A OF INTENTION TO CRFATE SPECIAL IMPROVEMENT DISTRICT NO. 293. IE IT RESOTNED TY THE CITY COUNCIL OF THE CITY OF KALISPELL, M0NTQR* SECTION 1. That it is the intention of the City Council of the City of Kalispell, Montana, to create Special Improvement District No. 293 for the purpose of Participating with the State Highway Commission and the Bureau of Public Roads for the widening and rebuilding of Idaho Street within the City Limits Of Kalispell, and the rebuilding of North Malu Street and Sunset Boulevard along the present right of way of U. S. Qghoay 93 from Idaho Street to Wyoming StreeL, according to the plans and sPecifications of Projects No� F 270 (7) and U 257 (14) of the moxinina Highway Camnission. SECTION 2. That the area to be included within said Special Improvement District shall be as follows; all lotsv blocks, and unplatted areas, exclusive of streets and alleYS4 lying North of the North Boundary of the Great Northern Railway Curpany right of way, between the East and West City limit boundaries of the City of Kalispell, but excluding from said Special %provement District all property owned by the City of Kalispell, and lots 13 to 22 inclusive of Block 16, lots I to 12 inclusive of block 15, lots 12 to 24 incluQve of Block 25, and IoLs I to 12 inclusive of Block 26, according to the official plat of the original townsite of Kalispell and all additioas thereto, nnd cf rec,,-)'rd le the Office of the County Clerk and Recorder of Flathead County, Mont�uia, and that the City COuncil Of the City of Kalispell, Montano, herehy finds and determines that the contemplated work or 0yrovement is of more than Tocal or ordlinary put>lic benefit, and that the real property included in such district will be specialty henefitted aid affected by such Improvement, 4nd the property included within the boundaries of said district is hereby declared to be the propeny to he a"eaged fac Ve Cwt and expense of making said im provenent. SECTION 3. That the general character of the InVrovements to be made in Lhe, proposed Special Improvement District is the widening of Tdaho Street to sevcnty- four feet and the construction of a four lane highway, with replacement of existing curbs and sidewalks, on Idaho Street and on North Maim Street and Sunset Bonlevard along the present right of way of U. S. qighway 93 from Idaho Street to Wyoming Street according to plaas and specifications of the State Iligh- way Commission and Bkweau of Public Roads, Projects No. F 270 (7) and V 257 (14) on file in the office of the State Highway Commission. 499 SECTION 4. That the estimated total cost of the entire program above mentioned, of which such Special Uprovement District is a part, is $440,000.00, and the estimated share to be bo-rae by such Special Improvement District i8 §110,000.00, or twenty-five per cent of the total cost of such project, whichever is the lesser. SECTION 5. That the share to he paid by said Special Improvement DistriQt in the estimated amount of $110,000.00 shall be assessed against all the prqrrty within the area described above on an area basis in proportion thot the area of each lot or tract bears to the total area in the district, except that each square foot of land within the district lying wiLhin 25 feet of the boundary line of the streets on which such improvements are to be made as designated bylthe specifi- cations of the State Uighway Conmission shall bear double the amount of cost of such improvements per square foot of such land that each square foot of any other land within the District shalt bear, such boundary line of the streets being the boundary line after the improvements are made, as per the plans and t-�pec. i fi cat tons reFerred to above. SECTTON 6. That said assessment shall be paid for W ten equal annual installments hereby extended over a period of tea years. Said assessment shall constitute a fund to be 1(nown as Special Improvement District Fund No. 293. SECTION 7, That said share of the cost of improvements shall be paid out of finds realized frwn the sale of Special Improvement DiUrict bonds issued *gajn*t said District in amounts not to exceed $5,000.00, hearing interest not to exceed 67 per annum frar the date of registration until called for redemption or paid In full. SECTION 8. That on the 7th day of Cutober, 1957, at the Council Chambers ia tM, City Hall of the My of Kalispell, Montana, at 7:30 P. M., at a regular meeting, the City Council will hear and pass upoa all protests that may be made against the making of such imlinvements or the creation of such District. Any person or persons wbo are owners of aRy lot or percel of land within said proposed, Special Improvement District who shall have, within fifteen days after the publication of notice of the adoption of this resolution del Wer, to the City CleK of the City of Kalispell, Montana, a protest IR writing against the proposed imptovement, or against the creation of said proposed SpqVal Improvement District or both, shall have the right to appear at said meeting in person, or by counsel, and show cause, If any there be, why the Improvemeat propomd to be mMe, sWuN not be mne or why such Spccial Improvement District should not be created. SECTION 9. That the City Clerk is bereby authorized and directed to give the. proper notice of the passage of this resolution by publication and mailing, as required by law, sucb publication to be made in the Daily Inter Lake, a daily newspaper published in the City A Kalispell, Montana.
